The Federal Communications Commission explains what the emergency broadband benefit is and who is eligible to receive the benefit and how people living on tribal lands will receive a higher benefit.
1. What is the emergency broadband benefit?Â
The Emergency Broadband Benefit is an FCC program to help families and households struggling to afford internet service during the COVID-19 pandemic. This new benefit will connect eligible households to jobs, critical healthcare services, virtual classrooms, and so much more. The benefit will provide $50 per month per eligible household or $75 a month per eligible household within tribal lands. It also will provide a one-time discount of up to $100 on a computer or tablet for eligible households.Â

In 1890, Louis Brandeis wrote a seminal law review article on privacy, defining it as “the right to be left alone.” In 1991, Congress enacted the Telephone Consumer Protection Act (TCPA) to reinforce that right. This month, the Supreme Court narrowed the scope of the TCPA in a manner that will increase the number of calls and text messages that you receive hawking various goods and services. You will not be left alone.
The TCPA, drafted before the invention of text messaging, prohibits the use of “autodialers” to make marketing calls. Autodialers are defined as devices that can “(A) store or produce telephone numbers to be called, using a random or sequential number generator; and (B) dial such numbers.” Violations of the TCPA incur a potential liability of $1,500 per call.

The Federal Communications Commission (FCC) estimated last year that 14.5 million Americans lacked access to broadband. However, a new report from BroadbandNow released this week shows that number is much higher, checking in at 42 million. Advertisement Hide
The digital divide, the gap between Americans that have access to high-speed and affordable broadband and those that don’t, has been highlighted by the coronavirus pandemic because people relied on the internet to work and go to school. Images went viral during the pandemic of children doing school work fast-food restaurant parking lots to connect to the internet.

On March 31, the Biden Administration released details on its “American Jobs Plan.” Containing $2.25 trillion in new spending, $400 billion in tax credits, and $2.75 trillion in tax increases, if passed as proposed, the plan would be among the largest pieces of legislation in American history.REF The sprawling nature of the proposal, which includes taxes, transportation infrastructure, schools, health benefits, economic incentives, and more, makes the package difficult to analyze and summarize for public debate.
This has become standard practice in Washington: Leading Members of Congress bundle disparate policy measures into a handful of bloated legislative vehicles per session, and deem them “must pass” in order to pressure rank-and-file Members to vote in favor of them regardless of their specific policy concerns.REF
