The Sandwich Conservation Commission has always taken a dim view of homeowners illegally hacking away at trees and brush in protected conservation areas. Sometimes property owners clear these wild areas to improve the view from their own homes and back yards. And sometimes homeowners cut back invasive plants and vines and believe they are performing a service. In the past year—possibly as a result of people spending more time at home due to coronavirus restrictions—incidents of homeowners cutting into the resource areas seem to have increased. At almost every bimonthly meeting lately, the conservation commission hears about deforestation of protective buffer zones. Earlier this month, after hearing about illegal clearing behind three homes on Knott Avenue in the Town Neck section of town, the commission members decided they must crack down on this chopping.

In trying to stymie one of the most popular breweries in the world’s bid to open a beachside oasis, they expected to face an angry sea of detractors. But Bailey said his clients have no gripes with Tree House Brewing Co. the business, only the way in which Sandwich officials have handled the Charlton brewery’s proposed taproom, beer garden and retail outlet on Town Neck Beach.

Tree House Brewery Hit With New Legal Challenges

Three new legal salvos this week were fired over the bow of a proposed taproom and retail beer sales operation on Town Neck Road. Boston attorney Daniel J. Bailey III has filed complaints with the Massachusetts Office of Public Safety and Inspection and the Sandwich Conservation Commission alleging that a building permit should not have been issued to Tree House Brewing Company. Tree House’s proposed business is located within a flood zone and a protected coastal wetland resource area, Mr. Bailey said in his letter to the state public safety office’s board of appeals. Mr. Bailey said he is bringing the complaint on behalf of four couples who live on Freeman Avenue, which is adjacent to the proposed taproom and beer distribution site.

New Brewery Proposed In Sandwich Faces Challenges

By WXTK News A new Cape Cod brewery is facing legal challenges.  The Enterprise reports an attorney representing several neighbors has filed complaints with the state Office of Public Safety and Inspection as well as the Town of Sandwich Conservation Commission claiming a building permit should not have been granted to Tree House Brewing.  The proposed business is within walking distance of Town Neck Beach.  The attorney argues the brewery is in a flood zone and a protected coastal wetland area.  A complaint has also been filed with the Sandwich Zoning Board of Appeals.  Camden Town Brewery Prepares Stock For April 12 Pub Openings
