Court denies stay request over demolitions on Super Highway

Seeks arguments from SBCA, other parties over hotel owners plea The Sindh High Court rejected on Tuesday a plea seeking stay on the anti-encroachment operation against hotels constructed at Super Highway. The counsel representing the hotel owners maintained that the land on which his clients have constructed the hotels is for both residential and commercial purposes. He contended that the Sindh Building Control Authority s notice pertaining to the demolition of these hotels was illegal. The court remarked that it would hear the arguments of the relevant authorities before issuing any orders on the matter and rejected the request for stay.

The counsel representing the affected residents informed the court that one of the partners of the residential project is in London and the other is in Dubai. He further informed the court that another project of theirs - the Creek Side Shopping Mall - is being constructed in Defence Housing Authority.

KARACHI: The Supreme Court on Wednesday came down hard on Cantonment Board Clifton (CBC) authorities for leasing out its land to private persons to build high-rises and failing to remove encroachments and issued notice to the top law officer of the federal government. A three-judge bench headed by Chief Justice of Pakistan Gulzar Ahmed and comprising Justice Sajjad Ali Shah and Justice Qazi Mohammad Amin Ahmed observed that the cantonment land could not be used to raise private buildings and there was categorization of such land, which needed to be examined. It asked the attorney general to assist it. The chief justice said that no progress had been made to comply with its earlier order to remove encroachments from the land owned by the federal authorities and rather more high-rise buildings were being constructed on such land.
