The General Court of the European Union (the General Court ) has confirmed this week that the eligibility rules of the International Skating Union ( ISU ), which penalized athletes participating in competitions not authorized by the ISU, infringe EU competition law.
1 While the EU General Court considered it appropriate for sports governing bodies to seek to establish common standards for the organization of sporting events, such rules should not unduly deprive third-party organizers from market access, and must be fair and proportionate to the legitimate objectives pursued by these rules. In addition, the EU General Court upheld the role of the Court of Arbitration for Sport ( CAS ) as the primary body for the adjudication of sports-related disputes.

Sun Yang loses latest legal battle in doping case

A legal challenge by Sun Yang against one of the judges who banned the Chinese swimmer for eight years in a now-overturned ruling has not been accepted by a Swiss federal judge.
Switzerland s supreme court said it deferred to the Court of Arbitration for Sport to decide if Romano Subiotto is eligible to serve on the judging panel at Sun s retrial.
Subiotto was picked by the World Anti-Doping Agency last year to sit on the panel of three arbitrators that imposed the ban on three-time Olympic champion Sun for violating rules at a sample collection.
Sun Yang is free to swim and the Court of Arbitration is on notice

The Swiss Federal Supreme Court s decision to set aside the eight-year ban given in February to Chinese world and Olympic swimming champion Sun Yang has made headlines around the globe.
It s a landmark case that is far from over with questions that go to the very heart of anti-doping, sports justice and athletes rights.
The decision is monumental in two ways.
Firstly, it s not impossible but extremely rare for the Swiss court to set aside findings of the Court of Arbitration (CAS). It does not review findings as you might expect in a traditional appeal process, but only considers matters of procedural irregularity .
