New York Employees May Begin Taking Paid Sick Leave January 1, 2021 - Employment and HR

On April 3, 2020, New York Governor Andrew Cuomo signed into law the New York State Paid Sick Leave Law, which provides New York-based employees with up to 56 hours of paid sick leave per year. (See our previous alert here.) Covered employees began accruing paid sick leave benefits at a rate of one hour for every 30 hours worked on September 30, 2020. Employees may start using their accrued sick leave benefits on January 1, 2021. The PSLL requires all New York private employers to provide paid sick leave, which employees may begin using as of January 1, 2021. The amount of sick leave that employers must provide their employees annually depends on the employer’s size and income. On December 9, 2020, the NY Department of Labor published proposed regulations clarifying a number of issues relating to the PSLL as summarized below.
