A man being sued for a 2013 shooting that injured another man at a Birmingham bar can argue self defense, the Alabama Supreme Court ruled Friday.
The ruling stems from a shooting outside Black Market Bar & Grill in the morning hours of New Year’s Day 2013.
The state’s highest court ordered the lower court to vacate its earlier ruling that the defendant in a civil suit filed after the shooting could not claim self-defense. The case can proceed to trial.
The Supreme Court on Friday held that Dalton Teal “presented substantial evidence” . “of self-defense.”

No charges will be filed in a north Birmingham shooting that left a man dead last week.
Birmingham police on Monday said the March 30 slaying of Jubraun Wright, 27, was ruled justifiable by the Jefferson County District Attorney’s Office.
Wright was found fatally shot to death about 9 a.m. that Tuesday in the city’s Fountain Heights community. He was discovered with multiple gunshot wounds outside of a small sedan stopped in front of an apartment complex where he lived.
Neighbors reported hearing multiple shots fired and said it appeared the two were shooting at each other. A person of interest was detained a short time later but will not be charged.

Mark Edward Smith is charged with unlawful carry of a firearm, driving while intoxicated, and
failure to ID. He remains in the Jefferson County Correctional Facility.
