A group of nine environmental and political nonprofits wants the San Diego City Council to hold a proceeding to potentially disqualify San Diego Gas & Electric from bidding on the city’s electric and gas franchise agreements because of a legal dispute between the city and the utility over a water recycling project.
“Our request is for a full-fledged discussion as an informational item so the facts are heard,” said Sonja Robinson, program manager for the Protect Our Communities Foundation, one of the organizations that sent a letter to all nine members of the city council. “And if it is determined that SDG&E is in breach over the material terms of the franchise agreement, then it is within the city of San Diego’s municipal code to debar them.”

The San Diego City Council has called a special meeting for Wednesday to vote on granting an extension to the soon-to-expire SDG&E franchise agreement, which covers electric and gas services within the city limits.
However, Mayor Todd Gloria’s office would not disclose the length of the extension the mayor will put before the council. And by the close of business Monday, SDG&E officials declined comment to the Union-Tribune about any details or negotiations it has had with the city about a possible extension.
According to the San Diego City Attorney’s Office, any addition to the existing franchise agreement must be approved by both the city and SDG&E.

Earlier this year, the city of San Diego filed a lawsuit against San Diego Gas & Electric in a dispute over the utility’s underground infrastructure obstructing the construction of a $1.4 billion water recycling project.
Now, a second and separate lawsuit has been filed on behalf of a San Diego resident claiming an agreement between the city and SDG&E to help get the project started is illegal.
At issue is the Pure Water San Diego Program, a project designed to reduce ocean pollution and increase the city’s water supply. The dispute centers on existing SDG&E equipment that is obstructing a portion of the project. The city says SDG&E should pick up the tab for moving the infrastructure but the utility has refused.
