Two Bills Relating to Auto Insurance Claims Practices Advance in Texas May 11, 2021
House Bill 359
The Texas House May 7 passed House Bill 359, which addresses delaying tactics practiced by insurers in claims involving uninsured or underinsured motorist coverage.
According to legislative analysis of HB359 by Rep. Charlie Geren, District 99, the legislation was filed over “concerns that insurance carriers that delay claim evaluations, significantly undervalue claims, or delay or deny payment on valid claims are not penalized for doing so. As a result, policy holders with valid automobile insurance claims are often forced to sue their own insurance company to receive payment under their auto insurance policy’s uninsured or underinsured motorist coverage.”

After Lenny & Joe’s Fish Tale restaurant in New Haven sued its insurance provider for refusing to pay for business losses related to the coronavirus pandemic shutdown, a federal judge dismissed the case within just six months.
U.S. District Court Judge Michael Shea in December granted AmGUARD Insurance Co.’s motion to dismiss the case, concluding the restaurant’s insurance policy’s virus exclusion meant any losses due to the pandemic weren’t covered.
Like Lenny & Joe’s, an array of businesses, from restaurants to manufacturers and medical providers, have experienced pandemic-related losses in the past year, and several have turned to the courts when their insurance carriers denied coverage.
The model "provides a structure to strengthen distracted driving laws across the country by establishing a comprehensive hands-free law to curb driver distraction," NCOIL said in a news release.
