NEW DELHI: The ministry of home affairs on Thursday bluntly reminded the Arvind Kejriwal government in Delhi that it remains fully accountable and in charge of health and other departments which as per the Constitution lie in domain of the state government, and that the amended Government of National Capital Territory of Delhi (Amendment) Act 2021 in no way changes the arrangement stipulated by the statute. The amendments to the GNCTD Act, 1991, in no way alter the constitutional and legal responsibilities of the elected government to take necessary action, in respect of the subjects transferred to them in the State and Concurrent Lists of the Constitution of India, including subjects such as health, education, etc, the home ministry said in press release a day after AAP questioned the timing of the GNCTD (Amendment) Act, passed by Parliament last month, coming into force.

As per the act, the government of Delhi now means “Lieutenant Governor (LG)” and the approval of the LG is required by the state government for implementing any executive action. “In exercise of the powers conferred by sub-section (2) of section 1 of the Government of National Capital Territory of Delhi (Amendment) Act 2021 (15 of 2021), the Central Government hereby appoints the 27th April 2021 as the date on which the provisions of the said Act shall come into force,” the notification signed by additional secretary in the MHA, Govind Mohan, said.
