An anesthesiologist and member of the medical staff at Dignity Health, d/b/a St. Joseph’s Hospital, brought a False Claims Act qui tam lawsuit against the hospital and Neurosurgical Associates, LTD, in which he alleged a bait-and-switch scheme whereby patients thought they were undergoing invasive and high-risk surgeries performed by highly regarded and experienced neurosurgeons. However, he alleged the surgeries were performed by inexperienced medical students with no oversight from their teachers. The alleged scheme allowed the experienced surgeons to bill Medicare for multiple surgeries performed by others at the same time, at the higher rate that Medicare reimburses for the highly skilled surgeons.

Dignity Health and its medical group Neurosurgical Associates agreed to pay $10 million to settle allegations that it defrauded Medicare.
Phoenix-based St. Joseph s Hospital, which is operated by Dignity s neurosurgeons, allegedly performed concurrent surgeries even though it billed Medicare for separate procedures. The amended complaint, which a whistleblower filed in an Arizona federal court in 2018, described it as a bait-and-switch scheme.
Dr. Bruce Kingsley, the whistleblower who practiced at St. Joseph, alleged that young and inexperienced residents would perform high-risk procedures with little or no guidance from a reputable surgeon, contrary to patients expectations. St. Joseph s Hospital and Medical Center and Neurosurgical Associates Ltd. â part of San Francisco-based Dignity Health â have agreed to pay $10 million to resolve civil allegations that they violated the federal False Claims Act.
According to a statement issued Wednesday by the U.S. Attorney s Office for the District of Arizona, the Phoenix health providers improperly billed Medicare for surgeries.
