Drug Dealer Sentenced
Last fall, Michael Schutt was arrested and charged with Conspiracy to Deliver a Controlled Substance to a Minor; Delivery of a Controlled Substance, and Possession of a Controlled Substance With Intent to Deliver- Marijuana. Two co-defendants were also charged in the case, Meagan Crone and Donald Brower. The crimes occurred last year on October 3rd and 4th. According to court documents, during a search of Schutt’s home, law enforcement seized approximately a pound of marijuana, various drug paraphernalia items and a large amount of cash.
Schutt, at a change of plea hearing in February, pleaded “guilty” to all three of the charges as part of a plea agreement that was reached with the state. District Court Judge John Fenn, at a sentencing hearing Tuesday, rejected the plea agreement and amended the sentence due to a misunderstanding at the change of plea hearing regarding the amount of time Schutt had served. A sentencing hearing was held Tuesday in Fourth Judicial District Court in Sheridan for 23-year-old Victoria Ruiz. Last year in October, Ruiz was arrested and charged with one count of Possession of a Controlled Substance With Intent to Deliver- Marijuana. In February at a change of plea hearing, Ruiz, pursuant to terms of a plea agreement reached with the state, pleaded “no contest” to an amended charge of Possession of a Controlled Substance.
District Court Judge John Fenn, at Tuesday’s hearing, accepted the terms of the plea agreement and entered a deferred prosecution and ordered Ruiz to serve three years of supervised probation. Judge Fenn also ordered Ruiz to pay $375 in various court costs and fees, which she must pay at a rate of at least $35 a month beginning June 1.

LAS VEGAS, NM Judge Gerald E. Baca was sworn into office Friday as a judge of the state Court of Appeals.
In a virtual ceremony, Judge Baca took the oath of office in a courtroom at the San Miguel County Courthouse. Chief Justice Michael Vigil administered the oath from his office in the Supreme Court Building in Santa Fe.
Trial Date Set
An arraignment hearing was held Thursday in Fourth Judicial District Court in Sheridan for 27-year-old Walker McMillan who is charged with one felony and two misdemeanors for an incident that occurred on March 6 of this year. McMillan pleaded “not guilty” to the charges of Felony Aggravated Assault and Battery, Misdemeanor Reckless Endangering and Misdemeanor Domestic Battery.
District Court Judge John Fenn scheduled the two-day jury trial to begin on August 23 and set the date for the pretrial conference for July 29 at 11 am. McMillan’s bond was continued under the same terms and conditions that were previously set in Circuit Court. According to the affidavit of probable cause, McMillan was charged with the crimes in March for threatening to kill an individual while holding a knife to their throat, and then punching the man in the face. A 61-year-old Sheridan woman recently changed her plea on a felony drug charge in Fourth Judicial District Court in Sheridan. Anneliese Panasenko pleaded “guilty” to the charge of Possession of a Controlled Substance With Intent to Deliver- Marijuana. The guilty plea was part of a plea agreement reached with the State that recommends the dismissal of a charge of Delivery of a Controlled Substance to a Minor- Marijuana. The plea deal also recommends a sentence of 3 to 5 years in prison, suspended in lieu of three years of supervised probation.
Panasenko was arrested and charged with the crimes last November after an investigation that resulted in her residence being searched by law enforcement that yielded marijuana that was packaged for distribution. District Court Judge John Fenn ordered that a presentence investigation be completed and set the sentencing date for June 24 at 9 am.
