Attorney: Columbus police charged client for anti-police stance, not abortion rights protest

A woman who was charged with protesting at St. Joseph Cathedral during a Respect Life Mass in January was specifically targeted because of her anti-police stance, according to her attorney.  Brian Bardwell, a first amendment attorney in Cleveland, filed a motion to dismiss the charges of trespassing and disorderly conduct against his client, Michelle M. Davis, on April 29 on the grounds of selective prosecution. The motion will be heard on Tuesday morning in Franklin County Municipal Court. Bardwell alleges that the Columbus Division of Police pursued charges against Davis  who was part of a group of four protesters charged following their actions at a Jan. 22 protest at the Respect Life Mass at St. Joseph Cathedral Downtown  because she also protested against police misconduct. Others charged include Jordyn Close, 24; Mason Hickman, 24; and Anne Morrice, 35.

For nearly two years, the village of Brice has operated a camera-based system of citing drivers for speeding violations without going through Franklin County Municipal Court, an apparent violation of state law. The village, surrounded by Columbus on the Southeast Side, has continued for the past year to issue the speeding tickets and collect thousands of dollars in fines in what appears to be defiance of an Ohio Supreme Court ruling. A recent graduate of the Ohio State University Moritz College of Law is now the latest individual to challenge the practice. Alexander Maxwell, unlike the majority of motorists who have been ticketed for speeding in Brice, had the advantage of three years in law school under his belt when he got a notice of violation in the mail from the village in December.

When Randall Mayhew was reinstated as a Columbus police officer in January, it didn t really shock Hannah Estabrook.  It did, however, sadden Estabrook, who was for several years a docket coordinator with the Changing Actions to Change Habits (CATCH) Court, a special court for prostitutes and women involved in human trafficking. She is now helping to build Sanctuary Night, a drop-in center on Sullivant Avenue that will focus on providing food, showers and other services with a focus on those women.  I was really disappointed, particularly because I know some of the women who were specifically hurt by officer Mayhew and they have overcome so much already, Estabrook said. The fact they found some courage to share their stories, they were even in some cases willing to be witnesses in his case. It s so remarkable to me and to respond to that courage with this kind of potentially crushing blow is devastating to me.

(Photo courtesy of the Ohio Governor s Office) Ohio Governor Mike DeWine Friday announced the appointment of Gina Russo to the Franklin County Municipal Court. Russo, of Columbus, will assume office on March 22, 2021, and will be replacing Judge Paul Herbert, who has retired. Russo’s appointed term to the Franklin County Municipal Court will expire on Jan. 3, 2022. She will need to run for election in November 2021 for a full term commencing on Jan. 4, 2022. Russo served as Judge for the Franklin County Court of Common Pleas from March 2019 to December 2020. In this role, she managed and presided over trials involving civil matters and felony criminal indictments. Previously, Russo served as Assistant Prosecuting Attorney at the Franklin County Prosecutor’s Office for seven years.
