CNMI passes bill banning Styrofoam containers

It has now gone to the Senate for deliberation. If passed there, a ban would come into force from the 1st of January 2022. It would ban styrofoam packaging for takeaways, packaged meat, eggs, bakery products and leftovers at restaurants. It, however, excludes polystyrene foam coolers or ice chests that are used for the processing or shipping of seafood and emergency use. The other exemption is food or beverages that come pre-packaged with Styrofoam at wholesale. The bill has set a civil fine of not more than US$100 per violation. Under the legislation, the Bureau of Environmental and Coastal Quality, Division of Environmental Quality may promulgate rules and regulations to implement the law.

Air Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Miller County Sand Plant Owner Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The CAO provides that PPL owns and operates a sand plant (“Plant”) in Doddridge, Arkansas. The Plant is stated to operated pursuant to an air permit (“Permit”). PPL is stated pursuant to a July 6th letter to have requested consideration under DEQ’s Environmental Self-Disclosure Incentive Policy (“Policy”) regarding installing and operating five fuel tanks that were not addressed in the Permit. The five tanks are identified in Paragraph 6 of the CAO. Pursuant to an email addressed to DEQ, PPL provided the correct number of tanks and their capacity in the July 6th Self-Disclosure letter. These tanks are described in Paragraph 7 of the CAO.

Asbestos Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Operator of Demolished Clay County Structure Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and Steve Champ (“Individual”) entered into a December 17th Consent Administrative Order (“CAO”) addressing alleged violations of Arkansas Pollution Control and Ecology Commission Regulation 21 (Asbestos Regulations). See LIS No. 20-193. The CAO provides that during the week of November 22, 2019, the Individual demolished or caused to be demolished a structure (“Site”) formerly located in Piggott, Arkansas. The CAO provides that: The reference structure constitutes a facility as defined in Regulation 21, Chapter 4 The Individual meets the definition of an owner or operator of a demolition or renovation activity as defined in Regulation 21, Chapter 4

Air Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Marion County Fiberglass Boat Manufacturer Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and White River Marine Group, LLC (“White River”) entered into a December 17th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 20-192. The CAO provides that White River owns and operates a facility (“Facility”) that manufactures fiberglass boats, boat trailers, and a line of fiberglass products for the boat industry in Flippin, Arkansas. The Facility operates pursuant to an air permit. DEQ personnel are stated to have conducted a routine compliance inspection of the Facility covering July 2018 through June 2019 on July 24, 2019. Further, White River is stated to have submitted an Annual Compliance Certification (“ACC”) report to DEQ personnel covering June 1, 2018 through May 31, 2019.

Air Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Mississippi County Carbon Processing Facility Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and Mid-Continent Coal & Coke Company (“Mid-Continent”) entered into a December 17th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 20-194. Mid-Continent is stated to own and operate a carbon processing facility (“Facility”) in Blytheville, Arkansas. The Facility operates pursuant to an air permit. Mid-Continent is stated to have submitted emission test results to DEQ for emissions testing conducted at the Carbon System Air Heater with Baghouse (SN-01) on June 30, 2020. SN-01 is stated to be subject to 40 C.F.R. Part 60 – Standards of Performance for New Stationary Sources, Subpart Y – Standards of Performance for Coal Preparation and Processing Plants.
