Code Ann. § 8-4-203(e), the Arkansas Department of Energy and Environment – Division of Environmental Quality (DEQ), Office of Water Quality, gives the following notice: City of Wilmot operates a wastewater treatment facility located as follows: US Hwy. 165, Wilmot, AR 71676 in Ashley County. The facility is currently permitted to discharge treated municipal wastewater into Bayou Bartholomew in Segment 2B of the Ouachita River Basin. City of Wilmot submitted an application on April 22, 2013, with additional information received on April 24, 2013, for the renewal of NPDES Permit No. AR0050989. The application has been reviewed by the DEQ’s Office of Water Quality and has received tentative approval subject to the terms of this notice.

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and the City of Dermott (“Dermott”) entered into an October 14th Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See LIS No. 20-182. Dermott operates a major municipal waste water treatment facility (“Facility”) in Chicot County, Arkansas. The Facility discharges treated wastewater to Bayou Bartholomew and eventually to Segment 2B of the Ouachita River Basin. Such discharge is undertaken pursuant to an NPDES permit. DEQ is stated to have conducted a routine Compliance Evaluation Inspection (“CEI”) of the Facility on January 22nd. The inspection allegedly indicated the following violations:

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and USA Truck, Inc. (“USA”) entered into a November 24th Consent Administrative Order (“CAO”) addressing alleged violation of an Industrial Stormwater General Permit (“Stormwater Permit”). See LIS No. 20-190. The CAO provides that USA operates transportation and logistics facilities in Crittenden County (“Crittenden County Facility”) and Crawford County (“Crawford County Facility”). Both the Crawford County Facility and Crittenden County Facility are regulated pursuant to the Clean Water Act for stormwater discharges. DEQ is stated to have issued Stormwater Permit coverage to USA for discharge of stormwater into waters of the state with an expiration date of June 30, 2019, to both the Crawford County Facility and Crittenden County Facility. The CAO provides that Terra operates land application sites (“Sites”) in Sebastian County, Arkansas. DEQ is stated to have issued a No-Discharge Water Permit (“Permit”) to Terra on May 31, 2016, which expires on May 31, 2021. Inspections by Arkansas Game and Fish Commission personnel regarding the alleged impact on a private pond in Hackett, Arkansas, are described in the CAO. Also referenced was the alleged presence of an oil-type residue on the surface of the pond, along with dead or gasping fish. DEQ is stated to have undertaken a complaint inspection upon referral from the Arkansas Game and Fish Commission. On April 25, 2019, a reconnaissance inspection by DEQ is stated to have identified the following alleged violations:
