Hefty fine fixed for release of seized vehicles

JAMMU, Feb 11: Expressing serious concern over failure of the Geology and Mining Department and Police to check illegal mining and transportation of minor minerals from River Tawi without proper permission and challan, a Division Bench of the High Court comprising Chief Justice Pankaj Mithal and Justice Ali Mohammad Magrey has issued directions for mentioning the names of the involved officials of any of the department in the FIRs so that investigation may also be conducted with regard to their role.
Moreover, the Division Bench, while modifying its earlier order, has authorized the Magistrates to release the vehicles seized on the ground of illegal and unauthorized mining and fixed Rs 50,000 as fine for first time violation, Rs 1 lakh for second time violation and confiscation of vehicle till completion of investigation pursuant to the FIR or the proceedings on the complaint.

The Madras High Court on Wednesday set aside fresh show cause notices issued by the Tamil Nadu Legislative Assembly’s Committee of Privileges to DMK president M.K. Stalin, 18 other legislators from his party and expelled MLA Ku.Ka. Selvam in September 2020 for having displayed gutkha sachets in the House in July 2017.
In her orders, Justice Pushpa Sathyanarayana observed that the Assembly should not only commence its proceedings with the Speaker reciting a couplet from Thirukkural every day, but “the legislators should also follow the Thirukkural in their day-to-day life both inside and outside the Assembly”.

The Madras High Court on Tuesday directed the Director General of Police (DGP) to constitute a special investigation team (SIT) to probe exclusively complaints lodged by motor insurance companies and others regarding numerous claims made before tribunals across the State using fake documents and insurance policies.
Justice N. Anand Venkatesh insisted that experts in solving cyber crime must be included in the SIT since many false claims were being made on the basis of policies supposedly taken online. He made it clear that First Information Reports could be registered at police stations across the State and then transferred to the SIT for investigation.
The Delhi High Court has reiterated that CFSL reports made by Government experts, which are admissible under Section 293 of CrPC without examining the author, are required to be tendered into .
