PHILADELPHIA – The parent of a minor who suffered head and burn injuries allegedly while using an iPhone 11 Pro cell phone and then sued Apple and Best Buy for damages, is now seeking to have the case remanded to state court.
Ashley Neiman (individually and as the guardian and natural parent of A.A., a minor) of Wilkes-Barre first filed suit in the Philadelphia County Court of Common Pleas on March 25 versus Apple, Inc. of Cupertino, Calif., Best Buy of South Richfield, Minn. and Chuck Sullick, of Wilkes-Barre.
“On Dec. 3, 2019, plaintiff purchased an Apple iPhone 11 Pro from Best Buy located at 449 Arena Hub Plaza, Wilkes-Barre Township, PA 18702,” the suit states.

PHILADELPHIA – Counsel for a Chester County woman, who claimed she was physically assaulted by an American Airlines baggage claim agent at the Philadelphia International Airport last year after inquiring about her missing bag, is seeking to remand the case to state court and add a defendant to the action.
Kathleen Makowka of Malvern first filed suit in the Philadelphia County Court of Common Pleas on Feb. 16 versus PrimeFlight Aviation Services, Inc., of Sugar Land, Texas.
The suit said the incident in question occurred between the hours of 7 p.m. and 9 p.m. at the American Airlines Baggage Claim Office in Terminal F, at the Philadelphia International Airport.

PHILADELPHIA – The owner and operator of Old City Beer Garden has filed suit against the City of Philadelphia’s Department of Public Health Office of Food Protection and its officials, claiming the organization closed his business without proper justification and violated his procedural due process.
Michael Stosic filed suit in the Philadelphia County Court of Common Pleas on May 13 versus the City of Philadelphia’s Department of Public Health Office of Food Protection, Terrance Carter and Joseph Mellon. All parties are of Philadelphia.
“Mr. Stosic operates Stoish, Inc. under the name of Old City Beer Garden. On May 6, 2021, the Department of Health stood in front of Old City Beer Garden. The Health inspector related to this matter is Mr. Terrance Carter,” the suit states.
