Gov t Costs Can t Force Immunity Appeals, Pa. Justices Told
Law360 (May 18, 2021, 3:48 PM EDT) An attorney for a woman suing Philadelphia s court system after she walked into a glass wall at a local courthouse told the Pennsylvania Supreme Court that the cost of taking the case to trial isn t grounds for an immediate appeal of a decision rejecting claims of sovereign immunity.
Jerry Lyons, an attorney with Chaiken Lyons & Gaynier representing Wanda Brooks in her case against the family division of the Philadelphia County Court of Common Pleas, said that allowing appeals of immunity-related questions in tort cases against government entities based on the alleged irreparable harm of having to pay to defend them.

ALLENTOWN – Defendants in a lawsuit brought by a Pennsylvania man who fell off a ladder on the job and sustained a litany of serious injuries, seeking product liability-related damages, have countered that the suit is groundless.
Wilben Gonzalez of Reading initially filed suit in the Philadelphia County Court of Common Pleas on Dec. 30 versus New Werner Holding Co., Inc. and Werner Co. (doing business as “New Werner Co.”) of Greenville, Home Depot, Inc. (doing business as “The Home Depot”) and Lowe’s Companies, Inc. (doing business as “Lowe’s Home Centers”), both of Philadelphia.
“Prior to Oct. 28, 2019, New Werner Holding and/or Werner designed, manufactured, assembled and/or distributed the subject ladder, a 32-foot aluminum extension ladder. PHILADELPHIA – The parent of a minor who suffered head and burn injuries while using an iPhone 11 Pro cell phone filed suit Apple and Best Buy for damages related to those injuries, while those companies have since denied any liability for the injuries in question.

PHILADELPHIA – Sixteen people who developed cancer, some of them fatally, and their families have brought suit against German medical device manufacturer B. Braun, alleging that emissions of a carcinogenic gas called ethylene oxide (EtO) from the company’s plant in Hanover Township led to their illnesses.
The plaintiffs filed suit in the Philadelphia County Court of Common Pleas on May 4 versus B. Braun Medical, Inc., B. Braun Of America, Inc., B. Braun Melsungen AG, B. Braun Cegat, LLC, B. Braun Interventional Systems, Inc. and John Doe, all of Bethlehem.
Ethylene oxide, or EtO, a chemical used to sterilize medical equipment, was deemed a human carcinogen by the U.S. Environmental Protection Agency. EPA data, according to plaintiff counsel, showed that the cancer risk from the colorless gas present in one Hanover Township neighborhood was substantially higher than the average amount measured statewide.
