On March 12, 2021, Governor Cuomo signed a bill that requires New York employers to provide paid leave to employees so they can receive a COVID-19 vaccination. The law took effect upon signing, and will expire and be deemed repealed on December 31, 2022. The law applies to both public and private employers.
The bill amends the New York Labor Law (NYLL), requiring that all private employers provide their employees with a “sufficient period of time,” up to four hours, of paid leave to receive a COVID-19 vaccine. The bill also amends the Civil Service Law, which applies to public employers, to provide the same leave benefits to public employees.

On March 12, 2021, Governor Andrew Cuomo signed into law an act requiring all New York employers, regardless of size or industry, to provide employees with paid COVID-19 vaccination leave of up to four hours per injection, effective immediately.
The law, which amends the New York’s Civil Service Law (public employees) as well as the New York Labor Law (private employees), mandates that employers provide a “sufficient period of time,” up to four hours for each injection, to be paid at the employee’s regular rate of pay. It prohibits employers from charging the time against any other leave to which the employee is entitled, such as paid sick leave or vacation time. It also bars employers from discriminating against or retaliating against any employee who takes or requests paid COVID-19 vaccination leave, or otherwise exercises their rights under the law.

The law amends the New York State Civil Service Law to grant public officers and employees four hours of leave per injection to receive the COVID-19 vaccine. Most notably, the law also adds section 196-c to the New York Labor Law, including similar language for private employees. This means that New York employers are required to provide

On March 12, Governor Cuomo signed legislation (NY State Senate Bill S2588A) that provides up to four hours of paid leave for New York employees in connection with the receipt of a COVID-19 vaccine.
Significantly, for private employers, the legislation amends the New York Labor Law (to add Section 196-C) to require paid leave for a sufficient period of time, not to exceed four hours per vaccine injection.
1 Because the leave is available per vaccine injection, those employees who received the Moderna or Pfizer vaccine are presumably eligible on at least two occasions (or more, if booster vaccines become available).
