Biofuels Coalition Welcomes Amicus Briefs in Supreme Court RFS Case

(NAFB) – A coalition of farm and biofuels groups welcome a Supreme Court brief filed by U.S. states supporting the coalition’s arguments in a case regarding small refinery waivers. The Renewable Fuels Association, National Corn Growers Association, National Farmers Union, and American Coalition for Ethanol offered thanks to Iowa, Nebraska, Illinois, Michigan, Minnesota, Oregon, South Dakota, and Virginia for filing the brief. HollyFrontier and other refiners are asking the Supreme Court to overturn the January 2020 appeals court ruling in which the court found EPA exceeded its authority in granting certain small refinery waivers. The brief from the states concludes that “the judgment of the court of appeals should be affirmed.”

Apr 01, 2021 As the U.S. Supreme Court looks to examine the use of small refinery exemptions authorized by the Environmental Protection Agency, several states filed an amicus curiae - or friend of the court - brief in support of the Biofuels Coalition’s challenge in the HollyFrontier Cheyenne Refining, LLC, et al., v. Renewable Fuels Association, et al. The Supreme Court will hear oral arguments on April 27 on whether EPA was right to provide the refinery with a hardship exemption under the Renewable Fuels Standard. The Tenth Circuit Court of Appeals on Jan. 24, 2020, issued a ruling that struck down three SREs that the court said were improperly issued by the EPA and held that the agency cannot “extend” exemptions to any small refineries whose earlier, temporary exemptions had lapsed. … In its amicus brief, the ABFA discusses the impact of SREs on producers of advanced biofuels, stressing that the petitioners in the case do not acknowledge the adverse economic impact that the renewable fuels industry must absorb when dozens of small refineries are excused from their statutory Renewable Fuel Standard blending requirements.
