EPA wants to retract three last-minute RFS waivers

By 5/4/2021 In a legal motion filed in Denver, the EPA asked a federal appeals court to vacate RFS exemptions granted to three small refineries during President Trump’s last day in office. The EPA, now directed by Biden appointees, said the outgoing Trump officials “did not analyze determinative legal questions” whether the refineries qualified for the waivers. The 10th Circuit Court of Appeals ruled in January 2020 that small-volume refineries could be given a “hardship” waiver from complying with the Renewable Fuel Standard only it they received a waiver in the preceding year. The ruling greatly reduced the number of refineries eligible for exemptions. Ethanol makers and farm groups say the market for corn ethanol was reduced by billions of gallons due to a surge in RFS waivers during the Trump years.

US Supreme Court hears high-stakes arguments in biofuels case affecting Iowa, Nebraska

Scientists are working to make the biofuel process more efficient and thus reduce carbon dioxide emissions and mitigate climate change. Oil refiners and biofuels interests squared off in oral arguments before the U.S. Supreme Court on Tuesday in a case with large implications for Iowa and Nebraska. As is usually the case, the justices grilled lawyers from both sides before submitting the case for a decision later, most likely in a couple of months or more. Hollyfrontier Cheyenne Refining LLC v. Renewable Fuels Association addresses questions over whether small refineries can request exemptions to the Renewable Fuel Standard. The standard sets the amount of biofuels that must be blended into gasoline and diesel. Small refineries are granted hardship exemptions in some cases.

Haverhill biodiesel proposal raises alarms about emissions, waste Modified: 4/23/2021 10:29:46 PM NORTH HAVERHILL A proposal by a biodiesel plant to increase production capacity is raising concerns among neighbors about its impact on health and the environment and raising complaints about lax enforcement of restrictions at Haverhill’s town-owned business park. The Massachusetts-based owner of the biodiesel plant at the Haverhill Business Park is seeking approval from the New Hampshire Department of Environmental Services to install equipment that would increase production capacity from 6.4 million gallons of biodiesel fuel per year to 7.8 million gallons per year. A public hearing on the proposal, which requires modifying the plant’s temporary operating permit with the state, is set to be held virtually at 6 p.m. Tuesday. The public hearing was scheduled after residents’ concerns asked the town in February to petition DES.
