NORTH PERRY, Ohio (WOIO) - The 33-year-old Michigan man accused of driving onto the Perry Nuclear Power Plant property and telling security he had a bomb was back in court on Tuesday morning.
Michael Fogelsong waived his preliminary hearing with Painesville Municipal Courts, meaning the case will be reviewed by a Lake County Court of Common Pleas grand jury.
The suspect’s attorney asked for a bond lower than the $100,000 bail that was set due to his cancer diagnosis and medical appointments, but the judge said Fogelsong remains a flight risk and must remain monitored.

The 33-year-old Michigan man police say breached the gate at the Perry Nuclear Power Plant appeared in court on Friday.
Michael D. Fogelsong was arraigned in Painesville Municipal Court on one charge of criminal trespassing. That charge is a 4th degree misdemeanor. He pleaded not guilty.
Retired Judge Michael Cicconetti, who was filling in in Painesville Municipal Court, questioned why the charge Fogelsong pleaded to was only one misdemeanor, considering Fogelsong s criminal history.
Judge Cicconetti said in court that Fogelsong had previously been charged with larceny of a firearm and larceny after breaking and entering, both felonies, in the state of South Carolina back in 2011.

NORTH PERRY, Ohio (WOIO) - The 33-year-old Michigan man accused of driving onto the Perry Nuclear Power Plant property and telling security he had a bomb faced a well-known Lake County judge.
Michael Fogelsong was arraigned by former Judge Michael Cicconetti, who presided over court on Friday morning in place of the normal Painesville Municipal Court judge while absent on vacation.

WARREN Six people applied to be appointed to a judicial seat on the 11th District Court of Appeals that will be vacated Tuesday.
Gov. Mike DeWine, a Republican, will select the next judge. Dan Tierney, his spokesman, said he can’t comment on when the appointment will be made.
“We’re aware of the impending vacancy and have started our work on it,” Tierney said. “We’ll be meeting with the candidates, getting input from the local (Republican parties in the district) and working with the (Ohio) Supreme Court. There are things that have to happen” before an appointment is made.
