On December 10, 2020, the U.S. Department of Health and Human Services’ Office for Civil Rights (OCR) released a notice of proposed rulemaking (NPRM) to amend the Standards for the Privacy of Individually Identifiable Health Information, 45 C.F.R. Parts 160 and 164, Subpart E (the Privacy Rule). In response to its December 2018 Request for Information (RFI) for public input on areas of potential modification to the HIPAA Rules, OCR received over 1,300 comments addressing, among other topics: modifications to promote information sharing to support value-based care; permitting family members and caregivers to receive information to assist in care coordination, particularly for individuals with substance use disorders and mental illness; and reducing the burden on covered entities imposed by certain documentation and administrative requirements.

After living week-to-week in the cheapest hotel she could find, Wendy Onofre, 27, was relieved to find a two-bedroom apartment in Anaheim, California, where she now resides with her fiancé, Davi Johnson, 26, their newborn son, and her five other children.
The family hit a rough patch, having lost their jobs amid the pandemic cutbacks and struggling to care for their children all out of school. They were happy to find some stable footing again. But her happiness was fleeting.
In July, her eldest son, Daniel Jesus Onofre, 10, developed a cough and a sore throat. Fearing he might have COVID-19, she took him to a hospital emergency room. The diagnosis wasn’t what she expected.

The UVM Health Network has made good progress recovering from a cyberattack nearly two months ago, with some work remaining to complete. Today, we shared more information about the attack and our response, and confirmed that it was ransomware. Our IT staff did find a note, which did not request money, but included instructions to contact the criminals responsible for the attack. UVM Health Network leaders did not follow those instructions and instead contacted the FBI.
Seven Days is reporting that this is the first time the hospital network has said this is a ransomware attack even though no ransom was directly requested in an unusual message from the supposed attacker. See Seven Days story HERE.

Notice of Proposed Rulemaking (NPR) to make significant revisions to the Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA. HIPAA was first enacted in the late 1990s and the health care system has seen significant changes since that time. Many of these changes, such as the emergence of the opioid problem and the increase in availability of digital health information, have resulted with many in the health care system advocating for revisions to the regulations that balance patient privacy against the needs for information sharing as part of the collaborative health care system.
