Bar promises tougher sanctions on sexual misconduct

In a consultation that opens today, the Bar Tribunals & Adjudication Service (BTAS) suggests that penalties for sexual misconduct should start at a suspension of over 12 months and finish at disbarment. The proposals are significantly tougher than the current guidance, under which a barrister found to have committed inappropriate sexual conduct in a professional context could receive a reprimand or a medium level fine.  ‘The view is that all such behaviour should attract serious sanctions not only to reflect the nature of the behaviour but to send a clear signal that it is entirely inappropriate and will not be tolerated at the bar,’ BTAS said.

Francis Evans QC, who was called to the bar in 1997, was found to have behaved in a way which was likely to diminish public trust and confidence. He was dismissed as a recorder in 2016 by the Judicial Conduct Investigations Office after consuming alcohol on court premises, leading to difficulties for court staff. Recklessly misleading barrister fined £3,000 | News

By Jemma Slingo2021-04-22T08:42:00+01:00 A barrister who made a misleading witness statement during arbitration proceedings has been fined £3,000 by the bar disciplinary tribunal. Andrew Rainsberry, who was called to the bar by Gray’s Inn in 2001, was found to have recklessly misled an arbitrator in 2016. According to a judgment published by the Bar Tribunals & Adjudication Service, Rainsberry made a witness statement which alleged the company in question had complied with aspects of an earlier arbitration agreement, when he knew this was not the case. In doing so, the tribunal found that Rainsberry had acted in a way which was likely to diminish the trust and confidence which the public places in a barrister or in the profession. The barrister was fined £3,000 and ordered to pay £7,542 in costs. The finding is open to appeal.
