Texas Lawsuit Seeks to End Open Borders

Texas Lawsuit Seeks to End Open Borders by Joe Guzzardi, April 1, 2021 While justified criticism about President Biden s border fiasco rages on, an interesting and significant legal action has gone largely unnoticed. Texan Brian Harrison, formerly President Trump s Department of Health and Human Services chief of staff, and co-plaintiff Steven Pace filed a 20-page brief in an Amarillo federal court which seeks to resume the Trump-era, no exception practice of returning unaccompanied minors to their home country. The suit argues that the Biden administration hasn t given a legal defense for ending the policy, which was intended to protect Americans health and well-being during the coronavirus pandemic. Named as defendants are Health and Human Services Secretary Xavier Becerra, Homeland Security Secretary Alejandro Mayorkas and Centers for Disease Control and Prevention Director Dr. Rochelle Walensky.

AHA wants HHS to issue waivers to 340B hospitals

(Photo by Westend61\Getty Images) The American Hospital Association is asking Health and Human Services Secretary Xavier Becerra to ensure that hospitals participating in the 340B drug pricing program continue to have access to the program despite changes in their payer mix as a result of COVID-19. The AHA specifically requests a Section 1135 waiver of the Social Security Act for certain 340B program eligibility criteria for 340B hospitals enrolled during the public health emergency that may have experienced a temporary change in payer mix due to the COVID-19 pandemic. The public health emergency resulted in hospitals suspending nonurgent services and shifting resources to treat COVID-19 patients. These actions, combined with a slow resurgence of patient volumes, lowered the proportion of hospital patients paying through Medicaid or Medicare.
