A judge is updating the process for red flag petitions in Marion County after prosecutor Ryan Mears office was criticized for not submitting a red flag petition to the courts against the FedEx shooter following a police run-in in 2020.
Superior Court Judge Amy Jones, who oversees red flag cases in Marion County, initiated the changes this week but they are not yet confirmed, court administrator Emily VanOsdol and IMPD Lt. Shane Foley told IndyStar. The judge will request that law enforcement officers submit red flag cases directly to her courtroom instead of through the prosecutor s office.
After that, two judges will decide if there is enough probable cause that the person is dangerous to initiate a hearing over their gun rights. Foley said the new changes will make the red flag process more efficient.

Update: The Marion County Prosecutor s Office on Thursday, May 27, 2021 announced Derek Oechsle was sentenced to 55 years in prison. His time will be served at the Indiana Department of Correction.
A man has been convicted of murder in the fatal shooting of 41-year-old Christopher Smith.
33-year-old Derek Oechsle shot and killed Smith at Jake s Pub, 1280 W. Southport Road, on the night of Nov. 29, 2019. Smith was with friends celebrating his bachelor party.
Oechsle was convicted of murder and criminal recklessness, Marion County Prosecutor Ryan Mears announced Thursday. A sentencing hearing for Oechsle will take place on May 20 at 2 p.m.

Former Fedex Employee Brendon Scott Hole, 19 who shot the Fedex victims was interviews by the FBi last year when his mother called police. FBI spokesman stated: SAC Keenan: “Many of you have already asked what the motive of this shooting was, and with less than 12 hours since the shooting, it would be premature to speculate on the suspect’s motivations.”

INDIANAPOLIS – On Thursday, April 15, 2021, the Indianapolis Metropolitan Police Department (IMPD) responded to 8951 Mirabel Road on a report of shots fired inside the FedEx Ground-Plainfield Operation Center.
Upon arrival, IMPD officers secured the scene and began providing medical care to the victims. IMPD officers located multiple victims including eight victims with injuries consistent with a gunshot wound who were pronounced deceased at the scene. The suspect, identified as Brandon Hole, was found deceased inside of the business

One of the young victims, Samaria Blackwell had an enormous impact on the local police and community. She had wanted to be a police officer.
The Avon Police began a campaign in her honor and today followed her to her final resting place.

INDIANAPOLIS (WISH) The president of the local police union said Thursday that Indianapolis Metropolitan Police Department gave the Marion County Prosecutor’s Office everything it needed to put Brandon Hole on a “red flag” list.
Rick Snyder, who leads Fraternal Order of Police Lodge No. 86, said putting Hole on the “red flag” list would have kept him from buying more guns before he shot and killed eight people at a FedEx facility near Indianapolis International Airport on April 15.
Synder said Prosecutor Ryan Mears dropped a very important ball. “Unfortunately, the lack of action by the Marion County prosecutor prevented a court hearing which could have resulted in not only the retention of the firearm in question but also could have prohibited the suspect from owning, renting, receiving transfer of or possessing any other firearms.”
