The latest indemnity service is designed for consultants who do not do any private clinical work, but it also offers indemnity for certain fee paying non-clinical work not covered by state indemnity for earnings up to a ceiling of €1,500 gross per year. It does not include indemnity for clinical negligence claims. Aimed at consultants working in public hospitals where all their clinical practice is indemnified by the State Claims Agency, MDU membership “provides support for medico-legal issues not covered by the state scheme”.

Data from NHS Resolution, which handles such cases on behalf of the NHS, reveals 62 clinical negligence claims against Oxford University Hospitals NHS Foundation Trust (OUH) were successful in 2019-20. A total damages bill of £6.3 million was paid out in relation to these claims over the year, while further legal costs totalled £895,798.

Someone can bring a claim against an NHS trust if it is believed they, or a family member, suffered harm or died due to negligent treatment. New figures show that in 2019-20, there were 33 successful claims of medical negligence made against the trust – which runs Leighton Hospital, Victoria Infirmary Northwich and Elmhurst in Winsford. A total damages bill of £7.6 million was paid out in relation to these claims over the year, while further legal costs totalled £641,624.

Data from NHS Resolution, which handles such cases on behalf of the NHS, reveals 76 clinical negligence claims against Brighton and Sussex University Hospitals NHS Trust were successful in 2019-20. The trust runs the Royal Sussex County Hospital in Brighton and the Princess Royal Hospital in Haywards Heath. A total damages bill of £14.8 million was paid out in relation to these claims over the year, while further legal costs totalled £1.4 million.
