State attorney general files suit against Girard company | News, Sports, Jobs

erunyan@tribtoday.com YOUNGSTOWN The Ohio Attorney General’s Office has filed a civil action in Mahoning County Common Pleas Court attempting to hold George Kuriatnyk Sr. of Girard and his business, K & M Shingle Recycling of Girard, responsible for the dumping of demolition debris and 1,000 tires at 4136 East Dennick Ave. on the North Side. The suit states that before May 31, 2017, Kuriatnyk was not the owner of the Dennick property, but he operated it. The site is not far from the Northeast Ohio Correctional Center. The legal action states that in 2013, inspectors with the Ohio Environmental Protection Agency observed construction and demolition debris, or C&DD, illegally disposed of on the Dennick property, and Kuriatnyk was notified of the violation. In 2016, the Ohio EPA director ordered Kuriatnyk to remove shingles and C&DD illegally dumped on the property, but he did not comply.

Staff report YOUNGSTOWN A Warren woman who worked at an Austintown assisted living center was arraigned Tuesday in Mahoning County Common Pleas Court on a charge of abuse of a patient. Samantha L. Garlow, 24, of 1512 James St. SE, pleaded not guilty to the fourth-degree felony charge. Bond was set at $10,000, and Garlow will appear for a pretrial hearing on Jan. 5 before Judge Anthony Donofrio. Prosecutors said Garlow had been accused of the abuse at the Victoria House assisted living center, 5295 Ashley Circle in Austintown. Appeals court overturns car case ruling | News, Sports, Jobs

YOUNGSTOWN The 7th District Court of Appeals has overturned a ruling in Mahoning County Common Pleas Court that dismissed a civil suit filed by a Warren woman over the purchase of a used car. The ruling means the case goes back to Judge Maureen Sweeney and her magistrate, Dennis Sarisky, for further litigation. Sweeney ruled Oct. 30, 2019, in favor of the request of Edward Wallace of Youngstown for summary judgment, meaning a decision by a judge without a trial. Wallace was the seller of the car. Sweeney ruled that Wallace did not violate the Consumer Sales Practice Act because there was insufficient evidence that Wallace met the definition of a “supplier” of goods or that he committed an unfair and / or deceptive and / or unconscionable act or practice.

YOUNGSTOWN Political corruption in the Mahoning Valley never seems to go away, and this year saw former Youngstown Finance Director David Bozanich, ex-Mayor Charles Sammarone and downtown developer Dominic Marchionda plead guilty to felony charges. Rather than go to trial on the 101 counts in an Aug. 30, 2018, indictment, the three took deals with Bozanich being the only one sentenced to prison for his crimes. This story ranks seventh in this newspaper’s Top 10 stories of the year. Mahoning County Common Pleas Court Judge Maureen Sweeney sentenced Bozanich Sept. 3 to one year in state prison for four crimes he committed as part of the city government corruption investigation. He also received three years of probation.

Man sentenced to 9 years in prison goes free on appeal | News, Sports, Jobs

YOUNGSTOWN A man sentenced to nine years in prison two years ago for striking a Smith Township police officer with his car walked out of Mahoning County Common Pleas Court a free man on Wednesday. Donald Holladay, 30, of Mogadore, had served two years in prison when he found out last month that the 7th District Court of Appeals had overturned his felonious assault and resisting arrest convictions, which made up seven of the nine years of his sentence. The court only left standing Holladay’s obstructing official business conviction and a probation violation, which accounted for two years of his sentence. He was released from prison Nov. 30.
