MONTGOMERY, Ala. (WSFA) - We are learning more about a case involving a 5-month-oldâs death.
Montgomery police say, Ricardo Ocana, 20, is charged with capital murder in the death of infant Austin Diaz Flora. Ocana is the infantâs father.
Court records show Ocana is accused of physically abusing the infant which resulted in multiple injuries including brain damage.

A Montgomery father has been charged in the weekend death of his infant son.
Police on Tuesday announced the arrest of Ricardo Ocana. The 20-year-old is charged with capital murder in the death of 5-month-old Austin Diaz Flora.
On Wednesday, April 7, police responded about 11:30 a.m. to a Montgomery hospital after receiving a report of an infant with life-threatening injuries, said Lt. Jarrett Williams. The infant boy was taken to Children’s of Alabama in Birmingham where he was pronounced dead Saturday.
Few details have been released but Williams said a forensic exam of the child resulted in the death being ruled a homicide.

MONTGOMERY, Ala. (WSFA) - A Montgomery man is charged with capital murder in connection to his babyâs death.
Montgomery police say a 5-month-old was taken to a Birmingham hospital with life-threatening injuries on April 7. The child was pronounced dead on April 10.
Police identified the infant as Austin Diaz Flora.
Austinâs death was ruled a homicide. Montgomery police arrested the childâs father, 20-year-old Ricardo Ocana, on Tuesday.
Ocana is charged with capital murder. He is being held without bond in the Montgomery County Detention Facility.

Investigators, however, reviewed surveillance video that showed he fired the shots “after the vehicle passed him and no longer presented an immediate threat that would have justified the use of deadly force” which resulted in the deaths of Dominique Williams and James Lionel Johnson.
Chief DeVaul said although police confirmed the men had been breaking into cars, Mr. Dixon acted outside his jurisdiction. He was not in uniform and “had no lawful or justifiable reason to shoot and kill Mr. Williams and Mr. Johnson.”
“Mr. Dixon was acting as a citizen when he approached these individuals, so we want our citizens to be our eyes and ears, but to call us to be good witnesses not intercede themselves,” Chief DeVaul said.
