Subscriber only A Coast man is one step closer to going to jail after he was sentenced for being a drunken pest at a popular Noosa Heads pizza bar. Peter James Cherry, 46, pleaded guilty in Noosa Magistrates Court on Tuesday to committing a public nuisance within a licenced premise and obstructing police. The court heard Cherry while on a drunken night out entered Somedays Pizza on Sunshine Beach Rd at Noosa Heads as staff were closing the restaurant. According to court documents, the victim said when she was in Year 7 she had a regular relationship with her father during the day but when her mother - a nurse - was on night shifts he would undress her and feel her breasts and vagina. The victim said the first time her father touched her sexually was during a fishing trip. Shortly after arriving at the fishing spot the victim said her father started kissing her around her neck and ears as his hands fondled her groin area underneath her clothes. The files said the next time the man touched her sexually was at their house in Brisbane, where he said he would let her stay up if she sat on his lap.
Crown prosecutor William Slack said a struggle ensued, during which Tobler headbutted a 63-year-old man. The other man tried to intervene and was thrown to the ground by Tobler. Tobler then pinned the 63-year-old man to the ground before leaving.
His previous crimes included violence and drugs, such as a 2011 conviction for entering a man s house and holding a knife to his throat. Tobler was also convicted in 2015 for assault occasioning bodily harm and common assault for an attack on a former partner. He had already pleaded guilty prior to Thursday s sentence to two counts of common assault and a count of assault occasioning bodily harm.
