Ex-Bolivian Prez Can t Redo $10M Wrongful Deaths Trial Loss
Law360 (April 5, 2021, 11:30 PM EDT) A former Bolivian president and a government minister facing a retrial on wrongful death claims that they originally beat were denied a chance Monday by a Florida federal judge to also retry claims they lost under the Trafficking Victims Protection Act over the killings of eight civilians by Bolivian solders.
U.S. District Judge James I. Cohn said the jury could have reasonably concluded the former leaders may not have directly ordered the killings, including that of 8-year-old Marlene Nancy Rojas Ramos, but are liable for them under the command responsibility doctrine.
