Immigrants and advocates are urging Democrats and President Joe Biden to quickly act on legislation to protect young immigrants after a federal judge in Texas on Friday ruled illegal an Obama-era program that prevents the deportation of thousands of them brought into the U.S. as children.
Plaintiffs have vowed to appeal the decision by U.S. District Judge Andrew Hanen, who declared the Deferred Action for Childhood Arrivals program illegal, barring the government from approving any new applications, but leaving the program intact for existing recipients.

WASHINGTON - A federal judge in Texas has largely halted an Obama administration initiative that grants work permits and reprieves from deportation to undocumented immigrants brought to the United States as children - calling the program “unlawful” even as he allowed the more than 600,000 young people already in it to keep their protected status. U.S. District Judge Andrew Hanen sided with Texas and other states in his ruling that President Barack Obama, a Democrat, overstepped his executive authority when he created the program. Hanen’s ruling called Deferred Action for Childhood Arrivals, or DACA, an “illegally implemented program” and said “the public interest of the nation is always served by the cessation of a program that was created in violation of law.”

Recipients of DACA, a program created by President Barack Obama in 2012 to shield from deportation undocumented immigrants who were brought to this country as children, have lived in uncertainty for years as the battle over their status played out in the courts and lawmakers in Washington failed to deliver on their promise of a permanent solution.

A federal judge in Texas on Friday ruled that the Deferred Action for Childhood Arrivals program is unlawful. The decision, by US District Judge Andrew Hanen of the Southern District of Texas, injected uncertainty into the lives of hundreds of thousands of young immigrants, as well as their families.
For now, however, those currently in the DACA program will be allowed to stay in it, even as the judge has blocked the government from approving the applications of new enrollees. Here is a breakdown of what his decision means.
