Batavia funeral director facing charges for not burying body

Updated: 10:30 PM EDT April 13, 2021 BATAVIA, N.Y. A Batavia funeral director has been charged with not burying the body of a dead person within a reasonable amount of time. According to the Genesee County Sheriff s Office, someone who had died on September 10, 2019 was in the care of the Michael S. Tomaszewski Funeral and Cremation Chapel until March 16, 2021. The sheriff s office says they were contacted about the situation on March 16, adding that the body was subsequently removed and buried. Michael Tomaszewski, 49, was charged with a violation of New York State Public Health Law 4200, and issued an appearance ticket. Tomaszewski is set to appear in the Town of Batavia Court on April 26.

Apr 14, 2021 A former Batavia funeral home owner has admitted misusing money for a prepaid funeral and failing to properly dispose of human remains. The Batavian reports Michael Tomaszewski pleaded guilty yesterday to charges including grand larceny, scheme to defraud and untimely burial. The theft may have totaled more than a half-million dollars. And Tomaszewski admitted failing to dispose of another body for 18 months and will face another misdemeanor charge. Sentencing is set for July 13, and Tomaszewski could face two-and-a-third to seven years in prison.
