Sentencing Law and Policy: Asking hard (but incomplete) questions about electronic monitoring as an alternative to prison

Asking hard (but incomplete) questions about electronic monitoring as an alternative to prison I am glad to see that NBC News has this lengthy new article about electronic monitoring under the headline Incarcerated at home: The rise of ankle monitors and house arrest during the pandemic. Unfortunately, the piece only scratches the surface concerning how the pandemic may have enduringly altered sentencing practices and the pros and cons of greater reliance on home confinement with electronic monitoring. I still recommend this piece, but I hope future coverage will gather more data and dig even deeper into  pandemic-era experiences on this important topic. In the meantime, here are excerpts from this lengthy NBC News piece:

AB 251: Makes various changes relating to juvenile justice

Dear Chair Scheible, Vice Chair Cannizzaro and members of the Senate Judiciary Committee: My name is Nila Bala, and I am the associate director of Criminal Justice and Civil Liberties Policy for the R Street Institute, which is a nonprofit, center-right, public policy research organization. I am also a former public defender from Baltimore city. I am writing in support of AB 251, which would improve second chances for youth in Nevada. We are in favor of this bill because we know that a juvenile record can severely impact a young person’s future prospects. Currently, if a juvenile has a criminal record, he or she would have to wait until age 21 to seal it. This bill will move up eligibility and automatically seal certain offenses at the age of 18. Additionally, it also authorizes expungement (or destruction) of juvenile records upon petition at the discretion of a judge.

Derek Chauvin sits in state prison to await sentencing for George Floyd s death

Created: April 21, 2021 04:11 PM Former Minneapolis Police Officer Derek Chauvin is being held at Minnesota Correctional Facility-Oak Park Heights on administrative segregation away from other inmates for his safety, according to state corrections. Hennepin County District Court Judge Peter Cahill said Chauvin will be sentenced in eight weeks. Chauvin left the court in handcuffs Tuesday after being found guilty of second-degree unintentional murder, third-degree murder, and second-degree manslaughter in George Floyd s death. I ve been asked a lot what did the lawyers say to Derek Chauvin in the courtroom as he was getting up and leaving,  said Mary Moriarty, former Chief Hennepin County Public Defender.   Usually, it s like, I ll be down to see you on such and such a date; we have an appeal, we ll talk about that; hang in there,
