A federal judge issued a searing letter to the Arizona Department of Corrections (ADC) regarding its non-compliance with a settlement over the lack of health care provided to inmates. Judge Roslyn Silver tossed out the agreement after six years of non-compliance stating that “[The] present situation must end.”
A settlement was reached in 2015 requiring numerous benchmarks be met within a reasonable timeframe. The Stipulations of the settlement specifically called for health care and maximum custody provisions be met.
Judge Roslyn cited testimony from, a physician monitor, oversaw seventeen mortality reviews demonstrating medical staff’s “failure to recognize symptoms, delay in access to care, and failure to address requests for care.”

PHOENIX â In a scathing rebuke of the Arizona Department of Corrections, a federal judge has ordered that the state agency will face trial for repeatedly violating a settlement agreement in a long-standing lawsuit over prison healthcare.
Judge Roslyn Silver found that ADC should be prepared to go to trial no later than November 1, 2021, according to her recent ruling which vacated the settlement.
