Va. Environmental Workers Equal Pay Class Struck Down
Law360 (April 6, 2021, 8:15 PM EDT) A Virginia federal judge on Tuesday disbanded a collective action brought by women at a Virginia environmental agency who allegedly made less than their male counterparts, saying they didn t have enough in common since the state could use their individual salary histories in its defense.
U.S. District Judge John A. Gibney Jr. granted the Virginia Department of Environmental Quality s January motion to decertify the collective action, just a day after ruling that the DEQ could use the female scientists prior pay to defend the alleged gaps.

The Virginia Department of Environmental Quality and more than 60 stakeholders in Northern Virginia are still thinking about winter – and reducing the environmental impacts of salt.
During winter weather, the use of salt keeps Virginia’s roads, parking lots and sidewalks safer, businesses and vital services open, and the economy running smoothly. However, unintended impacts can result in harm to aquatic life, corroded infrastructure and property, and increased salt levels in drinking water. Each year, environmental and property damage can cost thousands of dollars per treated lane mile.
To the editor:
It’s important city leaders hold people accountable for what they do. A case in point:
In 2018, city staff informed council members they’d sent letters and held a meeting with residents living adjacent to Strawberry Run’s proposed stream restoration, but “If the City receives negative stakeholder feedback, the City may rescind the [grant] application” to Virginia’s Department of Environmental Quality.
VDEQ was informed differently: that no resident responded to letters for a meeting. Residents couldn’t respond because only a year later – after the grant was approved – did staff actually send letters and hold a meeting.
