The total sentences amounted to nine years custody with a further licence period of five years. The defendant may go down. We licence period of five years. The defendant may go down. We are ust leavin the defendant may go down. We are ust leaving the courtroom, i defendant may go down. We are ust leaving the courtroom, Court I Defendant May go down. We are just leaving the courtroom, court room i leaving the courtroom, Court Room One at the old bailey, where we have been listening to the sentencing of Jaswant Singh chail, who pleaded guilty for treason, to treason. Mr Justice Hillyard summing up the case as you can hear going into a lot of detail. We heard thatjaswant as you can hear going into a lot of detail. We heard that Jaswant Singh chail is going to serve hybrid sentence, so what this means is, for now, he will remain in broadmoor hospital, a high security psychiatric hospital, until he has received medical treatment. That medical treatment thejudge received medical treatment. That medical treatment the judge says he needs before being transferred to serve a prison sentence. The 21 year old went into Windsor Castle on Christmas Day back in 2021, armed with a crossbow with the intention of killing the queen. Just before we do cross to our correspondence, Sarah Campbell, Outside Court, i want to let you know what our correspondence inside court was reporting on our bbc news life page. You can access that online. Just saying that Jaswant Singh chail was playing black cargo trousers. He has bought staff in the dock with him, a mixture of Security Officers and nurses from broadmoor. His family were there too. Lets cross live to Sarah Campbell, our correspondent, who has been Outside Court and following those procedures, following those procedures, following that long sentencing from the judge there, following that long sentencing from thejudge there, giving lots of detail. Sarah, talk us through that Sentencing Decision and the three separate offences. Sentencing decision and the three separate offences. Justice hillyard in court number separate offences. Justice hillyard in court number one separate offences. Justice hillyard in court number one speaking separate offences. Justice hillyard in court number one speaking for| in court number one speaking for what was about an hour and 20 minutes in the end, that lengthy sentencing. That is what open justice is all about now. It is about letting everybody know through the televising of these sentencing, exactly how they come to those complex decisions. Lets not forget, because the defendant pleaded guilty, there wasnt a trial, so a lot of the information was required at Sentencing Hearings and we heard it here today. Jaswant singh chail was charged with three counts. These are counts one, attempting to alarm or injure the sovereign, contrary to section two of the treason act 1842. The maximum sentence allowable for that would have been seven years. Count two, having an Offensive Weapon in a public place. We know he was carrying a Loaded Crossbow when he was found in the morning of Christmas Day 2021, in the private grounds of Windsor Castle, so he had had to scale over a fence to get into that private area near the private residence. The maximum for that would have been for years. Count three, making a threat to kill. The maximum for that would have been a maximum of ten years. That is what the starting point was, and what we heard there was Justice Hillyard taking us through why he came to the decision that he had. Just to reiterate what those sentences are. Count 144 months, count to 16 months, and count 348 months. They are to run consecutively, so one after the other. That makes a total of nine years in custody with a further licence period of five years. As you were saying, it is a hybrid order, is what justice were saying, it is a hybrid order, is whatJustice Hillyard has decided. This means that he will spend some of that time in broadmoor where he has been treated, and when it is considered that he has reached the point where that treatment is successful enough that they feel he would be able to go into the custodial system into a jail, effectively, then he will spend the rest of that sentence in jail, so a hybrid order ordered byjustice hilliard. We had the reasons for that. We heard that there had been much debate amongst three or four psychiatrists as to the level of psychosis that Jaswant Singh chail was undergoing, both on the day itself in December 2021 and also in the run up to that, and that is what the run up to that, and that is what thejudge had to decide, was the level of psychosis, the level of Mental Health issues that he was facing when he did what he did, which once again, is that he scaled a fence, got into the private area at Windsor Castle. He was carrying a Loaded Crossbow, and when he was approached by a Police Protection officer he said that he was there to kill the queen. Just officer he said that he was there to kill the queen. Kill the queen. Just while you are talkin , kill the queen. Just while you are talkinu, i kill the queen. Just while you are talking. I am kill the queen. Just while you are talking, i am taking kill the queen. Just while you are talking, i am taking a kill the queen. Just while you are talking, i am taking a look kill the queen. Just while you are talking, i am taking a look at kill the queen. Just while you are talking, i am taking a look at the | talking, i am taking a look at the bbc news life page, which you can access online if you cant continue to watch here on television, you can get it on the bbc news app, on your phone orjust head to the website. Daniel sandford, who is in Court Room One where the judge was delivering at sentencing, saying that Jaswant Singh chail remained impassive as justice that Jaswant Singh chail remained impassive Asjustice Hilliard said he would be receiving a hybrid order, meaning he will be sent to prison after he has finished his treatment at the high security psychiatric hospital, broadmoor. Mental health is a real key parts of this case, a real big focus there. Lots of detail given by the judge, talking about Jaswant Singh chail s Mental Health and some of the disorders, and this treatment he is going to have to have. The treatment that he has been going to have to have. The treatment that he has been having. Going to have to have. The treatment that he has been having. Lets going to have to have. The treatment that he has been having. Lets take i that he has been having. Lets take it through some of what, and this was evidence given by psychiatrists during the Side Sentencing Hearing that was held earlier this year. This is what the judges basing that was held earlier this year. This is what thejudges basing his decisions on. He talked about Jaswant Singh chail s Mental Health, as he was approaching december of 2021. We know that he had visited the amritsar area in india back in 2018. When he was asked why when he put forward a reason the motivation for what he did on Christmas Day 2021, he said it was in revenge for that. We also heard about this obsession with star wars, that throughout various hearings there was the talk of creating new empires by destroying old ones. Anyone who knows star wars knows that empire is a big part of that fantasy world, if you like, and this is what the prosecution was saying, that his thinking was partly informed by that fantasy world, the role of the sith lord. In that video he recorded four days before Christmas Day which he sentjust before he was arrested in the grounds of Windsor Castle, he was wearing a metal mask and he was calling himself darth chailus, and seem to have some sort of connection with sith lords, if you like, so that one element of psychosis, of hallucinations. The other elements which we heard the judge hallucinations. The other elements which we heard thejudge refer to many times, is that, in the months running up to December 2021, it would appear that Jaswant Singh would appear that jaswa nt singh chail thought would appear that Jaswant Singh chail thought he was hallucinating about three male figures. He thought he saw three male figures. Also then there is this ai chatbot, which will be interested in hearing about, that at the very beginning of December 2021, he logged onto a website and he created this chatbot, this ai chatbot, a female figure, who he called sarai. Over december, you remember that if delete my offence was carried out on Christmas Day 2021, he had an extraordinary number of online conversations with this ai chatbot. They said that he effectively began to think of her as a real person and he was talking. Some of the conversations were of a sexual nature, others were to do with this plot, this planned that he had to assassinate the queen. Several of the psychiatrists gave evidence during the Sentencing Hearing Talk about the fact that she was a motivating factor that any answers to his questions she was actively encouraging him in what he was planning on doing. At one point sarai rights to this chatbot, i believe this purpose is to assassinate the queen and sarai, replies, that is very wise. Again other evidence of hallucinations, of him becoming more and more detached from reality. What we heard in court was the judge deciding how much that was the judge deciding how much that was to do with what happened on december 25, 2021, and clearly that had a lot to do with it, but he also said that it couldnt take away from the seriousness of his actions, and as well as this order under the Mental Health act for him to get the treatment he needs for the condition he has, he also must serve a significant time in custody because of the seriousness of the offence that he carried out back in 2021.
