In a press conference, the Fulton CountyDistrict Attorney reiterated that all of these defendants are innocent until proven guilty, she also said that she is to ask a judge to try to push this case to trial within the next six months she intends to try all of these defendants together which could make her hopes of getting this to trial speedily somewhat of a pipe dream but we will see how that goes. In a statement, trumps attorneys call the events that unfolded shocking and absurd, they went on to attack the credibility of the witnesses who appeared before the grand jury, then handed of these indictments, and now we wait to see Donald J Trump and his other codefendants turn themselves in. But, lets look now at the political ramifications of this and what stands out, of course, with these State Charges, is that if mr. Trump is reelected in 24, he will not be able to pardon himself, or his allies. Will that make this is most challenging indictment . And, how will he deal with this politically . That is such an important point. It does, on its face, make it the most challenging indictment because even if he is elected as president again in 2024, he cannot make it go away, even the governor of Georgia Cannot make it go away. And as i understand, im sure experts talked about it, the governor cannot unilaterally pardon him. There is at least the potential that this is a case that could transcend even a successful re election for trump and put him in legal jeopardy as president if he was reelected, and create conditions and circumstances and legal questions. We simply have not had to do with that as a country. If trump does become the president ial nominee for the gop, how do they grapple with that . A fourth indictment, and of course, as even talking, State Basement again. Love, the vast majority of republican elected officials have made the decision that they are in with trump, until the end. Whether they want to be, or not, they have concluded that they cannot alienate his people, because they are so dependent on the voters that he mobilizes. They cannot really afford to send it to him in any way or draw any line. And they tried to tow this line, putting on a front that they are actually looking as united front when thats not the case. The are not hearing from many voices they trust, the counterargument, except on the periphery of the president ial race. So, they are along for the ride. The last themselves to his mass, as they did throughout his presidency, and, there are a minority of republicans were very uneasy about that, but right now, the dominant faction in the party is the trump faction, and he has he has his argument, that all of these statements are really a way to them by going after him. This might be considered a sidebar, but how big a problem is, politically, that georges District Attorney, fadi willis, did not answer that question, about how that document leads a little bit earlier, just before the official indictment . Because, critics are already climbing all over this. Looks, its going to be republican Talking Point. Im not sure they need a Talking Point at this point. You saw kevin mccarthy, the house speaker, but again, tonight, instantly before you possibly could have read through this very detailed luminous indictment, saying that this is a radical democrat attempting to subvert, the 2024 election, tuning the charge on its head. That is going to be the Point Of View of republicans. And, that leak, however, it came about, it gives them a weapon to do that. But that did not exist it would be something else. Donald trump put out a press release, but hes trying to allege here, saying that the prosecutor is the daughter of a black panther. So, in essence, he is repeatedly accusing her of being a racist. Evan bragg, lakisha james, two other africanamerican Criminal Justice officials of being racist. Hes essentially trying to fold all of these indictments into the predominately belief amongst Republican Voters, that the real victims of discrimination in the diversifying society are basically them. Whites, christians, conservatives, and even men. And so, that messaging is well in place for Republican Voters, is a completely different russian, whether independent voters who will will decide the general lecture on board with this claim that he is the victim of a massive nationwide conspiracy of prosecutors. And, the d. A. Wants to try all 19 descendents together, within six months, which will collide with the gop primary calendar. Already, getting pretty crowded with cases. What are the likely political ramifications of that . What do you think . First, until the legal experts i told you, the legal experts are dubious, that either of those things can happen, almighty can be tried together are much less in an expeditious manner. That is the next question. The other republican candidates, by a large, revoking the strategy of 2016, they have chosen to really minimize a direct confrontation with. They are still hoping that some external event causes voters to peel away from him and that they will be there to pick up the pieces if they have not alienated the sodas by challenging trouble ready to directly. And your significant. And obviously, through the indictments, that is not happening. If anything, that is happening in the context of the republican primary. It is the open question whether any larger share of Republican Voters would react differently if a trial is going on, much less if he is convicted, and your staff to say based on evidence, that there is not a lot of chance of meaningful numbers of Republican Voters peeling away from him because of that but that is still unpredictable. Former President Trump indicted for historic fourth time, along with Rudy Giuliani, mark does in 16 others, criminally charged on 41 counts in connection with efforts to overturn the defeat in the 2020 election. Trump charged with 13 counts including violating the states racketeering act, what is his legal peril in this Lease Indictment his legal peril and this one is quite strong. Actually, i think that, in particular, the state Racketeering Charge is a very powerful tool. It is a little bit easier to lose than the federal one. And, both, they share both of course being able to wrap up the codefendants even if each of them have not individually done all of the 160 some odd over it acts that were part of that conspiracy dossier. That is the real danger, like giuliani, you do not have to have done each of those acts. If youve done a couple of them, you are going to get hit with that liability. In addition to that, there is also a mandatory minimum sentence, for the Racketeering Charge, if convicted. So, legal peril here is pretty grave for him. And, this counts 28, involves that recorded telephone call, that trumpet made to georgia secretary of state, brad raffensperger, famous of course with trump, when Trevor Pressures him to find 11,080 votes. How strong is that evidence . This was recorded and what about the strength about all of the other evidence . That one, in particular, rosemary, the audiotape that kind of evidence is compelling to a jury, because trump is speaking, usually, you do not get to hear them speak unless there is something being taken surreptitiously. As a peer trial attorney, as a perspective on that, i do not know that is necessarily the strongest single piece of evidence because people might hear it and interpret it differently saying that he is not leaning on him enough, he did not make it explicit as an ask. , the rest of the charges, when you put those together, with it, it makes a very strong case. Because the indictments are very meticulous and it lays what we call speaking indictment, it lays out the story of what happened. And when you look at all of these different pieces, knowing on, between the false electorate slates, the pressuring, as well as the fact that he is going to be known at that time, that there are no further legal versus at that time, so everyone knew that they are really trying to overturn what they already said, this is why there is no problem. When you put all those pieces together, i think it makes a very powerful tool. And the date for this trial will of course he said by the judge, but georgia d. A. Fadi willis says that she tries all 19 descendents together, and to do that within the next six months. How feasible is that . Legally, i thin practically, its not too feasible. As wrong as accurately saying, i think most people will say thats pretty ambitious. Its not impossible. But unfortunately, this is not the only case that trumpet is facing. Theyre going to be legitimate scheduling issues that he would bring for the judge and of course, now, there is a multiplier of the other 18 co defendants, each of which will have their own lawyers, their own schedules, and so, that makes it particularly hard to push such an aggressive schedule. By contrast, you will see that the second federal indictment that smith george, but, it may have been met the Streamlining Issue but charging only trump. But here, of course, you have the folks that are deserving of a good defense and had to be treated with proper due process, that can really slow things down. And commuted charge on this. The minimum prison time could be around 5 years. And because these are State Charges, not federal, trump would not be able to pardon himself or his allies , if he is ultimately elected president in 2024. Given the evidence, and the charges against trump, could you see a legal path for him to avoid conviction . There is also a legal path to avoid the conviction. At the very least, you might retreat to something you call during altercation, which is to say that you just needed to appeals one person in the jury that feels that whatever the evidence says, i just do not think it is right that a former president is being charged this way. There is all of these other people involved, for example, he could basically try to point the finger, it was these folks, who masterminded this, it wasnt my idea, i was just taking the advice of these folks. Some of them, lawyers, like giuliani, some of them do not lawyers. That is really what his Legal Defense is. But, at this point, rosemary, the Legal Defense is intertwined that he is running for president. That really does make they are one in the same. Funding included in that.
