The 45th president of the united states, he will turn himself into the Fulton County jail at the end of next week, and in a sign of just how close we are to that stunning moment the Secret Service has been at the jail for weeks working with local officials to plan the former president s appearance, a mug shot, fingerprints, the whole nine yards. And what will this mean for the first Republican Debate, which is on wednesday . Plus classroom culture wars and up suburban atlanta district. School board has voted to fire a teacher read a book about Gender Identity to gifted fifth grade teachers. That teacher is with us tonight to tell us why she did it. But first lets begin tonight about what we know about Donald Trumps surrender in georgia on charges that he and 18 other people orchestrated a Criminal Enterprise to overturn joe bidens election victory. A cnn Law Enforcement official tells cnn that the former president is expected to surrender, either on thursday or friday of next week. And if that process is anything like what most criminal defendants experience, he could be waiting for hours to get his fingerprints and this mug shot taken. But this is, of course, the former president of the united states, and nothing like this has ever happened before, not in the least four times. The Secret Service has been planning for weeks, and the treatment of defendants being booked and processed on criminal charges in Fulton Countyoes vary drastically, casebycase, but it normally does include a thorough search, by a jail deputy. And medical screening, pretrial consultation, fingerprinting, and, of course, a mug shot. Unless someone tells me differently we are following our part, our normal practices, so it doesnt matter your status. We will have mug shots ready for them. Lets bring in former federal prosecutor Ellet Williams and michael singleton. So, elliott, this is supposed to be time number 4 for donald trump. He is going to go to the jail thursday and friday, according to a source. You have a sense of how the processing is going to look different in a county jail, versus a federal courtroom, or even the new york city, manhattan courtroom . The challenge here, abby, is you have a former president of the united states, who is entitled, by law, to 24hour Secret Service detention. And whenever the president is in the custody of someone other than Secret Service, it is cause for alarm. The question is, was he ever put into a jail cell, or the population . And number three, how was he handled . Setting aside whether he ought to be held guilty for the things he is accused of and so on, there are serious safety considerations. Now, another question we all have to ask is is this really just like any other case, or are there going to be accommodations made on the fact that it is a former president. And i do think that, despite the blustery you are hearing from the Fulton County sheriff, this is going to be different. The other jurisdictions, they have not needed to take a mug shot, Everybody Knows what donald trump looks like. So, there is that, but this is going to be a moment where, potentially they might decide to do that, just to make a statement that he is like any o just goingbe him. It will be a lot of other high profile people. Ru giuliani, the Rudy Giulianis of the world, mark meadows, former white house chief of staff, a very high ranking Government Official in his former life. You are a republican. What kind of moment is this for this country and for the party that we are seeing, this parade of people showing up at a county jail . It is an unprecedented moment. I think it is a moment, abby, and haley, that most americans would never have seen. I talked to migrant parents about this. We talk about politics often. And my grandfather said in 60 years he has been engaged in the political process even through richard nixon, he never thought it would get to the point where a president would be arrested facing what . 90, 91 indictments or charges, i mean, this is serious, a very serious moment for the republican party. But again we look at the numbers, donald trump is leading the pack. He has support. And if you somehow try to remove the guy, the question is for republicans we now lose those supporters making it impossible to compete . In 2024, i talked to one friend, a chief of staff earlier today, and he says some talks are trying to figure out we just stick with trump and say we go all in and hope to in jik next year . Or do we abandon him and many are leaning towards we stick with them. Meanwhile, elliott, trump is unapologetic as he has been drought this whole thing, but these cases are serious, and the georgia case is not when he can pardon himself out of. If you are his lawyers would you be advising him to talk, defend the lies, the election lies that led to this point . You know, i think if i was his lawyer what i would do is, number one, try to get the case thrown out on some sort of legal matter, try to move it into federal court, try to raise whatever avenues you have, for just making it go away. And not deal with the substance of it . Not deal with the substance of it. Then, i think all you can do as an defendant is attack the credibility of witnesses, attack the credibility of the evidence. And also, just make the point that i thought i won this election, and this was my attempt to advocate on behalf of myself. So, you sort of make your case about your own intent and everybody elses someone you cant trust. Which there isnt really a great way to go about it, but that is what Defense Attorneys had to do. This is going to be a train wreck kind of situation. You have a Republican Debate on wednesday and a potential surrender on either thursday or friday. Trump seems to be banking on the idea that, hey, any news is good news, even bad news of Me Surrendering in a jail, what you think how do you think this will be . All eyes will be on him, and if you are an average lay republican voter looking at this, looking at a pool of nine other candidates you are starting to ask yourself, do these guys actually have a chance . Or will it, indeed, be trump, and if it is trump, do i just told my nose and vote for the guy anyway, because i want biden gone . Or do i stay home, and i think looking at the polling data outside of the 25 of never trumpers who wont vote for trump no matter what, i think most Republican Voters are on the side of, if it is him, i will vote for him. It certainly looks that way. Elliott, standby for us. I want to bring in a criminal investigator and former service agent, abby. Abby, thank you for joining us. We are learning that the Secret Service, they have been at that Fulton County jail now for weeks preparing for this surrender. What you think they need to have down, before trump appears . They have had a lot of practice. It is really not a heavy lift. Hes actually going to a secure location it is a jail. Its got a lot of enforcement there. It is already locked down. So, usually when you have a movement, the most vulnerable point is in arrival and departure. That is really when a protect he, like trump, is most vulnerable. Once hes inside they will secure the facility. Got all of these Law Enforcement entities helping with the Motorcade Route and arrival of the departure. And the surrender itself. Now, the surrender itself is quite common. I would arrest individuals where i would allow them to surrender when they were, you know, nonviolent crimes. So, they will likely expedite the process for him. They likely dont want him to be there very long, so hes going to move to the front of the line whatever that looks like. They are going to process him. I think there will be a negotiation about what they do or dont do, because they really want to process him. Nobody really wants you have to think about it, the problem or the threat in their home that long a period of time. Yeah. And this jail, of course, is a different venue than some of the other places he has surrendered, manhattan and washington. These are jurisdictions that are very used to high profile, basically vip defendants. This Fulton County jail is actually known for its poor conditions. How does that affect where trump is kept, and how the Secret Service prepares for that . So, the Secret Service goes out in advance. It is what is called a site advance agent. So they send an agent in advance, they get ahead there, one week or a couple of weeks. They do an assessment of the whole structure, the building, the layout, what is this made out of, and you are doing an assessment, manpower, they will look at how many officers are there, what is the manpower like, do they have to bring in supplemental. Also have to think about the exterior, protesters, demonstrators. And you are also thinking about vulnerabilities. Is going to shop, who is going to have problems, and you are thinking about the safety, not just of trump, but other people in that area. They will do a thorough job. I done so many of these advances, and ive done them in places that you would think how are you going to do this . They can do this, it is really, i dont want to say it is another tuesday for them, but it really kind of is a methodical process that they follow. Fire safety, chemical, biological attacks, any lone wolfs. Any explosives. Everything you could think of, what is above, what is below, they will really do a thorough assessment, and i will tell you this, they dont want to have a bad day. Not just the Secret Service, but the facility itself. It would really look very poorly on them if they are not on their a game. Absolutely. The eyes of the world is looking at them. Even on this fourth time for donald trump. Abby, thank you very much for joining us. I want to bring in now a Senior Fellow at the foundation for the defense of democracies, thomas joslin. He was also a senior staff member for the january 6th house select committee. Thomas, many of the names that were brought up in the january 6th hearings, they are now facing charges in georgia. That is actually very different from even the federal investigation, where it is only trump. What was your reaction to both of those scenarios . That jack smith didnt charge those individuals, and that funny willis decided to do so . Well, i think they are pursuing different legal strategies, obviously. But i was impressed by miss williss indictment. I thought it was very comprehensive, and she laid out the case and narrative of conspiracy of overturning the election in a very efficient and methodical way. And i would point out that, in her indictment, even though she focuses on the charges, one of the things she does is she points out how these same actors likely violated the law in several other states. Count one, the rico conspiracy, she lists all of these different actions that also occurred in up to six other states, and she is basically begging i look at it as basically begging other prosecutors to charge file other charges that are similar. This is something that she did, you know, i think she did the right thing with the charges. It is curious that others arent following suit so far. It is curious, and we best that question here as well. One of the interesting things that emerged today from our own k file here at cnn, they have a video, showing tennis chesebro, whose name is in this indictment following alex jones, notorious, you know, huckster, basically. He is following alex jones around the Capitol Grounds on january 6th, williams was just on cnn with my colleague, katelyn williams, and he said that the committee wasnt aware of this video at all. Was this completely unknown to you all . I didnt know that Kenneth Chesebro was with alex jones. We certainly looked at thousands and thousands of hours of video of all of the footage, and certainly looked at a lot of Video Footage of alex jones, and it is quite possible that chesebro was in that footage and we just didnt recognize him. One of the things about him that we have been learning is more images have been coming out as of late that helped identify him here. Yeah, i mean, does it tell you anything more though about this question of what is the line . Is there a line between the people who were leading the Political Part of this, and the kind of election interference part . The fake electors . And the people who were breaking windows and breaking into the capitol . Does it tell you anything more about that . Well, you know, abby, one of the things weve seen in the press recently is how does somebody like Kenneth Chesebro, with his pedigree and education and up in the thick of this, sort of conspiracy to overturn the 2020 president ial election, and we are starting to get clues, assuming that he was with alex jones, because he was so pathetic to alex jones and his cause, and i dont think that is a bold assumption, it does start to tell us something about his view of all of this, and one of the things we documented on the committee and in the final report is that alex jones and his info wars played a very big role in the stop the steel movement, it is important to keep in mind that what alex jones is all about as antigovernment extremism, this idea that the u. S. Government is illegitimate, and in that that is the idea that it should be overthrown. So, the idea that alex jones would find himself there, and chesebro would be by his side, it does start to speak to the mindset of chesebro, who is also this political conspiracy , the heart of this conspiracy to overturn the election. But does it surprise you that neither well, certainly not jack smith, and i think that is where it would end up being if there was evidence to support it, jack smith was not able to say we are charging someone, anyone, with the violence on january 6th. Does that surprise you . You know, im not a lawyer, so im always curious how players make these decisions, but the way i look at it, its all part of the same package. So i dont think that there is really a firm line between political conspiracy and Political Violence. I think the Political Violence came about because of the political conspiracy. That is obvious. Every man on the street can understand that argument. Jack smiths indictment was very narrow the trump, and he focused on very specific charges, but we can even see in that special counsel indictment, he is saying trump is responsible for the attack. He says that throughout the speech for example, that trump gave him very incendiary, with the exception of one word, it was entirely incendiary. He cites that speech throughout the indictment. So, this is something that he just didnt charge and for inciting the attack, but he certainly places blame it trumps feet for. Thomas joslin, thank you very much. I want to come back now to elliott, and michael le. You are a lawyer, i do want to think about what you think about this video that has emerged. And this is an important question. The charges dont they really dont charge trump with january 6th related charges. Bonnie willis is dealing with some other issues, but does that surprise you . Yeah, those are two questions separately. In regards to Kenneth Chesebro on january 6th, gets much harder for him or donald trump or anybody to claim that what chesebro was providing was merely legalized advice and bouncing ideas around the president , when he is clearly palling around with alex jones on the day of january 6th. It muddies his avenues. So, to the second question about charging the president with a crime, ive been saying for a while it would be very hard to charge the president for a crime for the conduct on january 6th, because you would run into a lot of freespeech questions with the words that he said there and linking him to the actual violence, and then for seditious conspiracy, which some people have been charged and convicted of on january 6th, you would have to approve some agreement or conspiracy that is still thin, based on what is in the public record.
