The big question will trump be able to run out the clock in his classified documents trial and any moment a judge could rule on whether Fulton County Da Fani Willis is kicked off the Georgia Election subversion case for the first time in history, a sitting Vice President is visiting an Abortion Clinic. And thats what Donald Trumps lawyers are doing today. Theres a series of arguments that theyre going to need to make over problem we a series of hearings. But today, donald trump is not just any criminal defendant. And the argument his lawyers are going to be making is he was president. He took documents out of the white house. Thats because he wanted to say they are hit and they were not the president ial records that should belong in the federal government because he had the power as the president to say they were personal records. Thats the argument were going to hear from trumps site today. But the Justice Department has been very clear since the very beginning. The National Archives has been clear. That is not how it works. The president ial records act, which is whats going to be talked about in court today. That says that records just cant be deemed personal by the president if he sees fit, there are Certain Records that are the property of the Us Government and in a situation like this, where their National Security purity records, Justice Department says, its criminally problematic for someone to take records, even if they were the president while they were still in the white house they were National Security records because they could jeopardize the entire country. And those records belong to the government and the people of america. So that is whats the stake today. Were going to well be watching to see what judge Aileen Cannon does. There is quite a bit at stake for her. She previously is a judge who had ruled in favor of trump, giving him a lot of deference as the former president s. So well see where shes leaning today. We dont expect a decision from her on this argument today and whether to dismiss ms the case. But it is quite a critical hearing where trump is expected to be important. All right. Now, where multiple things are happening, trump and his codefendants are waiting to hear if the judge is going to keep or disqualify the Fulton County District Attorney from let the Election Subversion Case there. That decision could drop any time now and trump and his codefendants are also waking up to facing fewer charges there. The judge dismissed six charges of the 41 count indictment in the states in the states criminal case trump is now down three charges because of this. Cnns Kristen Holmes tracking this for us. She joins us now, kristen, what are you hearing about all of this you talk about, lets start with georgia. You talk about these six charges being dropped. Obviously, yes, this is a good thing for donald trump. What youre talking to his team, theyre really just waiting to see what happens with the District Attorney. They are obviously happy that there are less charges, but they would like no charges at all. They would like to see fani willis pulled off the case. They would like to see a way for them to get out of that case altogether. Now, when you look at the broader picture we have seen donald trump now wanting to participate in these various legal trials. One, today, Go Into Fort Pierce keep in mind there there are no cameras, there are no speaking engagements. There is no opportunity to see the former president yet he is still going. This is obviously not one of his Traditional Campaign stops in the courtroom. Now, after the judge tossed tossed out six charges, including three against trump, lets talk about this joining us right now is cnn legal analyst and former us attorney michael moore. Lets talk about dropping these charges, dropping any charges at this point, michael does what to the strength of the case against trump well, good morning. Im glad to be with you this the motion that was filed by the defenses called a demurrer. And what that is simply a challenge to the legal sufficiency of the indictment. It is standard and almost every criminal case, theres nothing particularly unique about this and what it does it ask . The court to look at their diet, but in find out a bit sufficiently puts the defendants on notice so they challenged whether or not hear the charges dealing with solicitation to get someone to commit a violation of their oath, whether or not those counts were laid out with enough specificity to move forward. The judge said they were not. Now, it has nothing to do and this is probably the most important line. It does not dismiss the whole case. And in fact, the da has the opportunity to come back and reindict on those charges to bring a new indictment, cleaning the cleaning up what the judge said was correct. And he also put in a footnote if the da disagrees with his decision, he would likely agree to let live appeal in the interim. So its a speed bump, its probably a little bit of an embarrassment to the District Attorneys office, but it is not fatal to this case. So the case will move forward. The question before or not they tried to reindict and put six cows back in or if they move forward, these six counts viewer im curious if you how you would advise on this because when you hear resubmit or seek an appeal, that sounds like that sucks up time necessarily. Obviously. So right way. What would you advise . Well, i think that the conduct at issue is spelled out in the rico charge. Thats the most significant the conspiracy count that remains in the indictment. The conduct is still there and i would just tell to move ahead. Just keep going. This indictment was probably a little fat to start with. So trimming it up was not a bad im not a bad outcome. It takes a little bit of burden off the state. It removes some appeal issues and frankly, you could have moved forward in this case with a much more truncated type type indictment in criminal charges. So moving ahead is not going to hurt him. Its not going to change the ultimate outcome at all. Just simply is these six kind of technical counts have now been removed. Lets talk about what kind of pending decision from the judge on whether or not fani willis, the District Attorney in Fulton County, will remain the lead will remain overseeing and running this case against trump and others. If fani willis gets dismissed, what happens does the does the case go to another county . And i then wonder, what is the significance of where the case would then land . Yeah georgia has whats called a prosecution, prosecuting attorneys council. In that council that the head of that agency they would find a District Attorney who would be willing to accept the case. So they would basically become special prosecutors if you will, are specially appointed das for Fulton County for this particular matter to move the case for. But remember that if that happens every decision about the case, then rest with that new prosecutor, that new District Attorney thats brought in. So he or she may say, well, you know, were moving forward just like we havent. He or she may also say, you know, something ive just ive looked at it and i dont think this is appropriate and im going to end the prosecution the case. So a lot of discretion moves forward if that happens. Now, i do think its likely that this case will not be heard this year, and i think the judge signaled that in this very recent order, he he when he talked about the ability to appeal and also think the further we get into the calendar with all these things that have been happening in the speed bumps at the state has been running into that. Its a pretty clear indication that we wont get there before the election. And i think if theres a new prosecutor pointed, theres no possible way to get to trial on the books and in the courtroom before the election all right. Lets see we can get some answers to this. So the name, date of birth, browsing history, what videos you look at, what videos you share, what videos you post, who your contacts saar, browsing history, but tiktok has also been accused of key locking, which is following what youre putting in the keyboard, which could lead to passwords, personal messages, and so on. Now, tiktok testified in congress that they only do that too. Seek out robots do debugging. But you cant know for sure because its a chinese company. The second thing is what they do it that information when the Chinese Government, from an intelligence standpoint, a hostile foreign power wants it. And the problem there is, they may represent that were not a government agency. We dont share that, but theres a 2017 law in china that says, and i quote now all organizations and citizen shall support, assist, and cooperate with the National Intelligence efforts. Meaning, if the Government Asks for a flow of data, all of it, or some of it, or one individual person the answer know from a company is not an option, right . I do want to ask you though, when it comes to the gathering of information and misinformation, i know thats been thrown out there as well. I mean, whats the big difference between google, facebook, or what we saw them do . Especially during election time, and how they collect information from american and how they share it and sell it and everything else. And the big difference is that last point which is if the Us Government wants that inform people in america, have this twotiered system of suspicion. So can they give it again . And will that extend the durability . There are also different ways of maybe giving chemotherapy beforehand to try to increase the durability.
