Now, one move that jack smith could make here and he sort of alluded to it in the briefing is a if the judge sticks by this ruling, if the judge says i am going to instruct the jury on this president ial records act offense then jack smith makes clear, i will appeal that and i will appeal it. Now, the other thing that jack smith might do is ask the Appeals Court<\/a> to remove judge cannon from the case. Now thats quite a drastic step. It is very rarely, not never, but very rarely taken by prosecutors. And theres no assurance that they win. But the irony of all of this is if jack smith appeals this and if jack smith asked the Appeals Court<\/a> to remove judge cannon that will delay this more than anything. Thats happened so far. And apollo, you have actually spent time, unlike maybe ellie has. I certainly havent had a chance to in a lot of the courtrooms that donald trump and his legal team have been on various cases that hes facing right now when it comes to Aileen Cannon<\/a>, you mentioned that shes inexperienced. Let me give a little bit of her background here. She was appointed by donald trump. Just in 2020 shes been a Federalist Society<\/a> member since 2005. No experience presided over presiding over class its a fight cases. Whats it like being in the courtroom with her . So when i was in the courtroom, what struck me issues, obviously very conscious of the fact that shes under enormous scrutiny. She knows that she clearly comes prepared with tough questions for both sides to at least give the appearance of being fair to everyone. But her inexperienced shows through im just talking about when youre in the courtroom, when the Special Counsel<\/a>s office and trumps lawyers as they are known to do, sort of get into it and start getting a little petty, keeping the control that theyll control of her courtroom is something that she didnt demonstrate such a contrast to, for example, judge tanya chutkan, who oversees the other Special Counsel<\/a> case here in dc. She has been on the bench for and years. Shes not having any of it. Shes able to keep things moving along very quickly and keep her courtroom under control. And then you see sort of what comes through in the filings or the lack thereof. I mean, Aileen Cannon<\/a> still has over a dozen very significant motions and issues hanging out there based on what ive seen in the courtroom, based on what weve seen in the filings, it appeared heres it in some ways shes maybe just almost too afraid to make some of these decisions, understanding how much scrutiny she is. Is it a friend or is it deliberate that is really one of the questions and elliana, bring you back in here just to remind people, it has been 34 days, 34 days since cannon held a hearing on scheduling the maralago documents, trial. We thought maybe we would here very shortly after that announcement, 34 days ago. And when the trial would be and here we are. Yeah. I think the chances of this case being tried before the election are now approaching zero. Even jack smith is acknowledging theres no way this case will be tried in may as it was originally scheduled. I agree with paul. I think the issue here is the judges inexperience. I actually disagree with a narrative thats out there. The judge cannon is somehow in the bag or pulling for trump because she couldnt dismiss this charges. She actually rejected an argument by donald trump that these charges should be dismissed outright, but i do think that as Judge Cannons<\/a> realizing now, its not easy to manage these cases. It takes experience. You have to juggle a lot of different motions. Theyre complicated. You have to get get a lot done and i also agree with paul that judge chutkan in dc, who is more experienced both as a judge and in the courtroom, is showing much more command of the facts in the case in front of her. So look inexperience is a real issue here, and i think shes learning on the fly and its probably not the Ideal Scenario<\/a> for that paula la two of my favorite lawyers, and that says a lot.
