heard pete talk about the succession plan for who takes over the special counsel investigation. the president could pick somebody or might see somebody like the solicitor general step in. in your view, can that be a credible leadership of this special counsel investigation or is any talk of credibility shot through the window if rosenstein doesn't end up with this job? >> my guess is noel francisco would step in. it's important to know about him. he's from the federalist society and out of the university of chicago law school and has a pretty expansive view or at least we have henced he has an expansive view of executive power. the concern is what happens with the mueller investigation is he controls the budget. he's in charge. he can say there's no budget for foreign travel. no, you can look at russia but we're not going to look at obstruction. so whoever is in charge and supervising mueller is in a position to limit what we can and cannot look at.
