Faith was driving along Pahīatua St towards the roundabout connecting Te Awe Awe and Albert streets just after 6am on December 2, 2019. Brosnahan attempted to pass through the intersection on his way to meet a friend for an early morning bike ride. He had right of way and previously told the court he slowed to about 20kph to check for oncoming traffic before entering the roundabout. As he manoeuvred through the intersection, Faith’s vehicle clipped the rear of his bike, sending him flying through the air. His $7000 bike was written off and he suffered a break to his right leg, near his knee, after landing on a concrete island.
