The two attorneys spoke with the judge and the preliminary conference hearing began, lasted 510 minutes. Rex heuermann in his black coat suit, khaki pants, staring ahead with no emotion as they discussed the fact that they have to begin the long process, weekslong process of turning over 13 years worth of evidence involving these three murders that hes accused of committing to the defense. That process is going to happen on a rolling basis. The d. A. Saying theres about eight gigabytes worth of evidence. None of the evidence that has begun to be turned over doesnt include the evidence that they removed from the house after that 12day search there were at least two Family Members that fox has identified, sisters of two of the victims inside the courtroom today. Obviously they have chosen not to speak to the press as of this moment. The people also absent was the two children of Rex Heuermann. They were not inside this courtroom. In fact, they have not visited the jail where Rex Heuermann has been over the last two weeks. That brings me to what asa has said to the New York Post. The estranged wife who filed divorce. Martha i thought it was interesting in that quick interview with michael brown, he asked does he wife, heuermanns wife, think hes innocent. Does she . Well, the only thing that his wife knows about the charges is what is relayed by the press. Like mr. Brown just said, were not trying it in the press. The only thing shes heard is from the media. She has no independent knowledge, no recollection of what the dates she was in the country, when she went on vacation 10 to 12 years ago. She doesnt have any judgment of guilt or innocence at all. Martha but shes not made any effort to speak with him . All the Jail Telephone Calls are recorded. Any inperson visitation at the time, i dont trust being not recorded either. Weve had to limit her conversation to anything but the facts of the case. Then we have not advised her to go in person yet. I dont trust the facilities not to report the conversation. Martha is she requesting a desire to speak to her husband . Listen, at this point in time, shes trying to protect her children and put her own life back in order. How the criminal case will play out, shes aware it may take a year or two before theres a final result one way or another. Martha i guess what im getting at, when she had the realization that he was being arrested for these heinous crimes that have been plaguing them where they live for over ten years, is it your feeling that she felt, yes, this is probably what happened or that shes vehement in this theres no way my husband did this . Theyre divorcing. Shes filed for divorce. She needs to protect herself and her own assets. Whether she believes hes innocent or guilty, that will come out in time. Any criminal case, whether its your own family or a stranger, the media has the person convicted the men theyre arrested. The evidence will play out in the courtroom. Shes seen none of the evidence or heard the ed other than when played out on the media. They have destroyed her entire house. If you read the affidavit that supported the arrest of Rex Heuermann, its shocking the amount of evidence that is now going to be the basis of the prosecution. Yes, hes a suspect. Yes, its due process. Yes, theres a long road ahead of us. You have to read the affidavit and see the deep coordination by law enforcement. Not just the local police but they looped in the fbi. Those resources, they have been gathering evidence over ten years. Its amazing what they have done. Digital evidence, photographs. They linked Burner Phones to Rex Heuermann. Theyre giving the Justice Department two weeks to hand over the documents and other information in how they arrived at that plea deal. Saying the judge raised serious concerns about this agreement. She said it was unprecedented. She asked the prosecution, you ever seen a deal like this . They said no. So now theyre trying to come up with a new deal that the judge will approve. Martha so you had a liquor distribution business. Now President Biden was considering a run in 2008. As i understand it, hunter and beau approached you and said look, we need 75,000 for billboards. What happened then . I raised the money for them. Then two years later, the government looked at a interview in the local newspaper. They investigated the contributions and found out that they were made through my company through my employees through the company. And that was a violation of the law. Martha so your employees did they encourage did hunter and beau biden said you can divvy this money up . A plan for the money . The person that did that was dennis toner. Thats the campaign manager. Beau and hunter talked to me about it at the bar after the third debate at drexel university. And then dennis came over and said, how many employees do you have that you can trust . I said all of them. Have them write a check. They know whats going on. They knew what was going on then. Thats why they have people like me that were considered bundlers or could raise money. They know whats going on. Martha what did they do to help you when the fbi came knocking . Well, when the fbi came knocking, i being a law abiding citizen, i sat down and talked to him and was happy to do so. The minute that i cooperated with them. The Mitigating Factor is that i cooperated with the government. When dennis toner and i spoke and he said he didnt know what i was talking about, the next day that unsealed the indictment, wouldnt let me talk to the bidens and would not now it certainly makes sense what i was suspecting back then. Certainly makes sense now. Martha what do you mean by that . Well, they were protecting the bidens then, theyre protecting them now and i think the evidence is overwhelming that when Attorney GeneralMerrick Garland said that he treats like cases alike, thats really what upset me. I can tell you no, sir, you do not. You do not treat like cases alike. Thats why i filed my intent to file a brief called an amicus brief to help the court understand because shes required under statute 18 u. S. Code section 3553 a6, shes required to enter a sentence, one of is seven factors that avoids desperate sentences of defendants that have been committed defendants with similar records that have been found guilty of similar conduct. Normally that done to protect people from getting a sentence higher than they should get. But in this case, its to guard against somebody getting a sentence lower than other people got. Hunters tax loss is in the millions of dollars. Its the highest that delaware has ever had aside from a drug dealer or someone charged with other multiple crimes, this is a misdemeanor with a tax loss of over 1 million. My tax loss was 361,000 and i was in jail two years. Martha its extraordinary. As you point out, generally these plea deals are done with the highest chargeable offense. This is completely not that. This is really the lowest in many ways. Quick thoughts and then i have to let youd go. In fact, hunter and one thing i point out to hunter, hes the only personal charged with a standalone misdemeanor in delaware in the last 30 years. Its probably for history. Nobody has ever been charged as a standalone misdemeanor with failure to file without a Primary Charge of tax evasion, which they have in the statement of facts that they report. He told his california accountants that he underreported income and tried to deduct things. So they certainly could do a more even job. I hope the court will consider my brief and what impact that people who have been through the process and who have been treated martha its a great point.
