No doubt this is the most wide ranging of the four indictments that former President Trump is facing. Here in fulton county, georgia, foni willis saying that they were operating as a criminal enterprise. Heres a snippet from that indictment. Defendants refused to accept that trump lost and they knowingly and willfully joined a Conspiracy Top unlawfully change the outcome of the election in favor of trump. Trump faces 13 criminal charges including a racketeering rico charge, which if guilty carries a fiveyear sentence, 25,000 fine or both. The other 18 defendants include his former chief of staff, markmer doughs, rudy guliani, john eastman and sydney powell. The 98 Page Indictment alleges the defendants lied and committed fraud to persuade Georgia Legislators to reject georgias duly electoral vote and to replace them with fake electors. Hunter biden and his lawyers are saying it wasnt fair. The government reneged. The government said we didnt reneg on anything. David spunt has more. How things change in three weeks. Three weeks ago tomorrow when david weiss, the now Special Counsel and hunter biden were in a courtroom in delaware before a judge. They were moments away before it fell apart in open court. Now the Special Counsel is fighting back against Hunter Bidens attorneys writing the government did not as you say reneg on the previously agreed upon Plea Agreement as the defendant inaccurately asserts in the first substantive sentence. Hunter bidens attorneys say the Diversion Agreement on the gun where hunter is accused of lying on a gun form is valid because it was signed by both parties. The way hunters team is framing this is that chris clark may be a witness in an upcoming case about this Plea Agreement falling through. Tom, i want your take on Hunter Bidens lawyers demanding the Department Of Justice honor that part of the plea deal. Seems to have been blown up now and nowhere near getting back together. What do you think . Im very skeptical of Hunter Bidens lawyers argument that this is binding and valid. It was not approved by the judge. Although theres some truth that Diversion Agreements are different than Plea Agreements, i dont see how they can have a Binding Agreement if the Justice Department does ant agree that this Diversion Agreement is in effect. Its all fine and good for Hunter Bidens legal team to say were going to follow the terms of the Diversion Agreement. If doj doesnt see it that way, i dont know how much good it is for them. Neil katie, id like to get a sense of what david weiss who is in this capacity in a grander role, whether he changes right now, broadens the case himself, whether republicans who arent a fan of what hes done before in being a key part of that plea bargain can be trusted here. I think weiss is compromised. Hes allegedly looked into this case for five years. I cant imagine what Additional Investigation hes going to undertake. Im not optimistic in terms of any sort of legitimate differences in the outcome here. Again, i agree that that plea bargain is not going to be in effect at this point because part of that required that the judge actually act as a fact finder in terms of the terms of that probationary deal. That is a null and void argument. Neil if i can go back to the trump case, the fourth indictment against the president. I am curious that in this one, in particularly in georgia, he cant pardon himself out of it. What does that mean . Yeah. Thats true. Its different under state or federal federal offenses but cannot pardon state offenses. It just underscores the potential serious any of this charge. Its one thing for former President Trump to be fighting off charges in the federal system where potentially he would have a pardon power down the road. On the state side though, the calculus shifts. He couldnt pardon himself and he couldnt direct a georgia prosecutors to drop the case. So i think it underscores the significance, the potential severity of how this plays out. Also wouldnt surprise me that if President Trumps legal team tries to blow this case out of state court and pull it in to Federal Court where the president would think he would draw a more favorable judge and would draw a more favorable jury pool. Martha neil i can understand the defense will always want to postpone and push back trials. That i get. I can understand the prosecutors wanting to in in particular case expedite. But theres a lot of cases here were talking about. A lot of charges. 91 criminal charges. Do you envision any of them as they stand now getting adjudicated or even addressed before the election . Well, the right to a speedy trial is by and large a defendants right. Every prosecutor has said that. The defense needs time to go through the ed, all the discovery and ultimately any of these defendants, including donald trump, if they decide to release counsel on the eve of trial, they will likely be allowed to do so, which would prolong the trial even further. So i think for all practical purposes, its going to be very difficult to get these cases to go to trial. These are complex litigationtype cases. Within the next six months in my opinion. Neil so having said that, tom, and this this georgia case specifically and uses the rico act, largely reserved for mob figures and the like at least in the past, the likelihood of that getting done before the election or at least even starting before the election seems remote, but could i miss something here . Id say its remote to zero. I dont see how this case moves forward quickly. The prosecutor made the decision to swing for the fences. She named nearly two dozen defendants. She included sprawling charges. Any time they try to manage a case with nearly 20 defendants, particularly a case like this one that is on a complicated facts, conduct that expands years, theres no way you can move it forward quickly. Too many variables, too many balls to juggle in the air. Not to mention the possibility of trump tries to remove it from state court to Federal Court that will add months to to process. Look, neil, i cant think we look at these indictments without the context of three other separate indictments. Several of which came in the last four months alone. Four different indictments in the middle of an election. It sets an awful precedent in our country for the ruling party, the power in party to use the police force to indict political opponents in the middle of an election. I say this as somebody im polling at second in this race, third overall. It would be a lot easier for me if donald trump were eliminated from competition. But that is not how i want to win. The way we win elections in this country is we convince the voters of this country of our vision and what we stand for. Thats why ive said i would pardon for the federal crimes donald trump to help move this nation forward. I am focused for example on your economic message. Thats what we need to be talking more about. Less about the politicized indictments that have distracted us from the fundamental issue. Thats the fault of the biden doj and the democrat prosecutors across the country instead of explaining why bidenomics is a farce, a failure with more job openings than people looking for work. I say yes, these prosecutions are wrong. Neil i can understand that. Theres 91 criminal charges in all, vivek, as youre aware over 4 criminal cases. They cant all be politicized, can they . Something that the former president must have done in any one of these that struck you as wrong if not illegal. I think just because the government has brought a case, if were going to be a culture that says there must be something wrong if the government has charged 91 counts, thats a people of sheep. That breeds a government of wolves. Thats the reality. Neil you dont think theres anything in this case that shows or even strongly hints of the former president trying to reverse that georgia contest . Neil, you know, ive had this conversation before. Theres a difference between a bad judgment and an illegal act. I view this indictment in the context of as you put it, three other independent indictments. The first beginning in new york for a novel election and Campaign Contribution theory to one that has a novel theory interpreting the president ial records act to a novel theory of Attorney Client relationships. When you have a series of novel theories used to inindictment a prior president and a sitting candidate, i dont think its good for the country. Im this to lead our nation forward, not to be a political commentator or legal analyst on a series of legal cases. What i will say as a candidate in this race is that i do not think its good for our country to set this precedent. Neil i understand that. But if there is if there is wrong doing, vivek i understand. When you have the republican governor of georgia who has said this report is irrefutable and that this was an attempt at voter fraud that was scorching and you have others that have taken similar views including Secretary State that is republican, that said that donald trump went too far, wouldnt you put your trust or at least your instincts in those guys, republicans that said that this has been wellexamined, aggressively examined and there was nothing to it. Neil, im running to be our next president. I ask what is in the interest of this nation. Do i believe that these prosecutors or these elected officials or these federal prosecutors are advancing the interests of this nation when they bring this unprecedented indictment, n
