I want to deal with something thats come up in recent days and that is the health of your colleague, Senator Mcconnell<\/a> who talked today at the stakeout, take a listen. Im going to finish my term as leader and im going to finish my senate term. Bret Senator Mcconnell<\/a> didnt talk about it much the freezing specifics, he pointed to the physicians letter. How is he, number one and are you concerned about leadership going down the rude. He seems fine now and im glad that dr. Monahan, the attending physician released a letter yesterday saying that all the tests that had been conducted, Neurological Tests<\/a> and others ended up negative. So in his view, this was maybe just a little bit of a rocky recovery. Bret from that concussion . From a concussion. You probably know this but the older you get, the little harder it is to come back. None of us are 25 years old anymore. Bret you know, this is a bipartisan thing, senator welch. Obviously Senator Feinstein<\/a> from california has gotten criticism from democrats Dean Phillips<\/a> pointed out Goodness Sake<\/a> the Family Friends<\/a> and staff of Senator Feinstein<\/a> and mcconnell are doing them and our country a disservice. Its time for term limits for congress and the Supreme Court<\/a> and some basic human decency. What do you say to people who say, you know, it is time for some of these folks to mo on . You know, Senator Mcconnell<\/a>, speaking on behalf of him, he is totally committed to the institution and he will always put that first my observation was similar to yours. He was great today. Senator feinstein is having a much more challenging time. And when you talk about her situation. Friends and family obviously have prevailed on her. She was President Pro Tem<\/a> and she gave that up. She was the chair of the Senate Judiciary<\/a> committee. She she gave that up. She is determined from everything we hear to try to finish out her term. Bret i want to move to the topic you are here to discuss this bipartisan effort really to change the existing law. Explain, its a little technical but basically to help victims of Terrorist Attack<\/a>s. Well, in 2016 we passed a law that provided an opportunity for the families of lost loved ones and the terrible tragedy the Terrorist Attack<\/a> of 9 11 to be able to go to court and to be able to prove who financed that and who made that possible. During the obama administration, we were able to pass this. Ultimately over a veto. There had been some concerns expressed, diplomatic concerns by the administration. But now the argument is being made that somehow this is limited only to persons and not businesses and Property Damage<\/a> that is also the result of the same incident the 9 11 attack. Bret senator welsh, its important . It is important. Just to step back for a minute, the doctrine of sensory Immunity Sovereignimmunity<\/a> allow states e involved in things that injure our citizens immunity from being held accountable. This legislation was a breakthrough on that. And it would give people that access to justice. These corrections that were making now are going to mean businesses who have been injured also have a right of action, as john said. It means that its going to be more possible to collect on your judgment, getting a verdict. But not getting the money. Doesnt at all help. So, im glad that were standing up for the 9 11 victims. They can feel forgotten and the injuries are brutal and, in vermont, good ways from new york. We had 35 families that were affected by. This. Were looking at the victims of State Sponsor<\/a> of terrorism 13500 claimants, 6 billion. Its being said that essentially its running out of money this fund, this Special Master<\/a> has determined there will be insufficient funds to authorize an additional round of payments by january 1st, 2024. You are coming up to another fiscal cliff, senator, where you are dealing with the house. Is this all going to get rolled up together . It will all get worked out in the end. We always figure it out after we exhaust every other possibility. But, well figure it out. Some of this is by design because here we where 15 legislative days between now and the end of september. We should have done this work a long time ago. But, unfortunately thats not the case. Bret the house has said that they dont want to operate this way. They dont want to do behind closed doors. They dont want to do omnibus lastminute deals. And thats something they ran on. So is this going to be a tough bumpy road to getting this figured out . No, its definitely a tough and bumpy road. I think much more so in the house than the senate. We have gotten really good bipartisan cooperation with the chair and fight vary. Democrat and Republican Senate<\/a> appropriations committee. So i think we have got a shot at doing whats called regular order. But, this is a residue of really many years in congress of not having the committees be the ones that are the primary presenters. Bret both parties. Thats been in both parties. Its a breakdown of the institution. Its very, very bad for the country. But this is a new situation we have got in the house where there is a lot of folks who are really arguing that shutting the government down is a way to get to good outcome. We like to fight occasionally and sometimes thats the right answer. But sometimes actually interested in passing legislation, the only way can you do it is for democrats and republicans to find that overlap, what i call the 8020 rule. The 80 we could agree on and leave the other 20 to fight about on another day. So sometimes its important to stand and fight. And to disagree. But sometimes its important to be able to make some progress and the only way you can do that is by trying to build a consensus. It takes some humility to be in congress. You come with the benefit of having been voted in by the people you represent. Its a good country. People that elected me, im not sure would elect john. People that elected john would never elect me. And the fact is its a big, complicated country. So there has got to be some Mutual Respect<\/a> here that each of success doing the best we can for our citizens and focusing on what they all need i think is the way forward. This gun charge could and probably should have been filed years ago. Its an open and shut case according to many legal experts i have spoken with. They could have indicted in 10 minutes. But here we are years later, finally getting it once david weiss has become a Special Counsel<\/a>. He has been embarrassed twice before. Once by the irs whistleblowers and then with the plea deal following apart in court. After each of those he came forward with a new sort of Box Checking Exercise<\/a> saying look, no, we are going to be serious about this. There will be accountability. I suspect this might be the latest element of that same pattern but im open to changing my mind. Amy . You are open to changing your mind that its . Bret evolution. Yes, that it could be something more or that its youre not cynical about. Im open to changing my mind about david weiss and his approach to this investigation if some of those other elements, the financial misdeeds. Are open. Fara on other things are aggressively pursued. He has shown no appetite for any of that so far. Yeah. I guess the real question and you are starting to hear this from democrats more and more is what the team biden does, the campaign and the president himself and whether theres more pushback on this, whether they talk more about this this a way that we havent seen before there are allusions being made right now to the ways in which the Kerry Campaign<\/a> in 2004 allow the swift vote adds to go on for a long time without responding and that essentially shaped the narrative around that issue. So, i think beyond the fact that this has legal repercussions for the political piece, i will be very curious to see if democrats start to push more on seeing biden go back at republicans and try to redefine. Bret there is two tracks, the investigation and what is happening on capitol hill. I want to turn to covid. We talked yesterday, charlie, about this video of the Medal Of Honor Award<\/a> and the president coming out and he was wearing a mask at first. And then he presents the award to the Medal Of Honor Recipient<\/a> and it doesnt have a mask on and then does the whole thing, the presentation and then walks out before the end of the presentation before the convocation and the whole thing. Heres how the White House Press<\/a> secretary described that. The president took off his mask, as i said he would, to deliver incredibly powerful remarks about this captain, Captain Taylor<\/a>, and what he did in service to our nation, and he wanted to honor the captain. You all reported that, noticed that he left when there was a pause in the program because, again, he wanted to minimize certainly his impact on folks who were there. Bret minimize his impact on the covid front . Yeah. No. It defies everything here. You know, Captain Taylor<\/a> is 81 years old. Is he right there in the sweet spot of people who are vulnerable to covid. Bret by the way first lady, obviously has tested positive. Exactly. And but it could be very serious for a guy like that. She sat there yesterday and told us that he was going to wear a mask indoors and outdoors until and only when appropriately distanced we take his mask off. And then he proceeds to take his mask off, walk up to an 81yearold unmasked person and put the medal of honor, pin it around his n neck in very, very close proximity and then walks off, which is the strangest part of all of it. Bret they said it was because of the 15minute timeline or something. Right. And then they come back today and try claim oh, no, he was actually looking out for the wellbeing bei of Captain Taylod<\/a> other people at the ceremony. They may try to pretend like they are taking it seriously. They are not taking it seriously. And, either that or they are lying about it. And i dont know which is worse. Bret amy, how big a deal is covid going to be in election issue. Starting to fell to like we are seeing it bubble up again. Though in many of the states where this was a significant issue in 2020, some of those states now have republican governors. So we may not see that same level of lockdown. I will be very curious to see in some of these Bluish Leaning<\/a> states if they are spread in the schools, if we start to see over the course of the fall a higher incidence of this. Whether those same governor also be thinking maybe we will not have the same level of mandates and School Closures<\/a> that we had in 2020. Due to science, of course. Bret were going to do it differently it depends state to state. Yeah. Bret one issue that will come up is border security. Look at the latest poll about the job approval for the president. 61 disapprove. This is coming not just from republicans. Here are some local democrats calling out the president s policy. I am delivering an urgent and formal appeal to the federal government for intervention and action. We need leadership from President Biden<\/a>, period. We need that leadership right here in New York State<\/a> because, you know, New York State<\/a> is struggling. We need the National Government<\/a> to stand up. This is not a new york city issue. This is a national issue. The City Of Chicago<\/a> cannot go on welcoming new arrivals safely and capably without significant support and immigration policy changes. Bret i mean that is a change, all of that in recent months. I think this is a moment to reflect on the wildly successful political stunt, yes, but an effective one by Governor Abbott<\/a> in texas to force a lot of the politicians that you just saw, not just to talk the talk about Sanctuary Policies<\/a> but to actually confront what being a sanctuary looks like in the middle of a giant crisis caused by their party. And i think absent those bus trips, and those relatively small handful of migrants, we wouldnt be dissension in the ranks among the democrats. It would be texas problem to deal with. Charlie, this is interesting. I mean, obviously the former Vice President<\/a> is trying to make a mark. We knew this was going to be exciting, and it is. No, its kind of interesting to listen to mike pence suddenly wake up and be all upset about populism. I mean, he hitched himself to the most populist campaign since Andrew Jackson<\/a> and rode it all the way into the white house very happily. As he himself noted trump governed as a conservative. And so i dont really understand how he is now going to say but he is not going to govern as a conservative next time or is he going to distance himself from the fact that that sort of populist agenda got him closer to the white house than anything else would have. The only issue d diverge on is ukraine donald trump is far more in line with the American People<\/a> on Something Like<\/a> ukraine in both the Democrat Party<\/a> and Republican Party<\/a> than mike pence is on that issue. I dont really see exactly what his argument is here is. Bret is he trying to change the dynamic. The dynamic is not changing. The Wall Street Journal<\/a> poll has the former president expanding his lead exponentially. You see ron desantis going down. Nikki haley and Vivek Ramaswamy<\/a> picked up some points from previous polls but, amy, the dynamic in this race really has not changed it has not. Mike pence has not gotten any more popular. Is he less popular with Republican Voters<\/a> than he was, lets say, at the end of 2022. I think that speech was also notable for being a pretty serious swipe at the other person he has a beef with, and thats Vivek Ramaswamy<\/a> who he at the debate as you very well know. Bret i remember it well. Im sure you do is very much against seeing him get any traction. So, if he cant take out a donald trump, maybe at least can make a dent in ramaswamys now asen dense in the polling. Bret what does he call him. Imitators. He had a few digs he ignored. You put the numbers on the screen. This is trump and everyone else. If you are going to try to make a move, you have to train some fire at trump and see if it works. So far it hasnt for basically anyone, and if thats going to change any time soon its going to be a dynamic that will be brand new to us. This race is just frozen in ice right now to trumps advantage.
