And of course, you would if you speak to the lawyers, if you speak to the human Rights Groups in the charities, they would say, far from gaming the system , what doing is , what they are doing is offering the best advice and help to people in a desperate situation to ensure that they stand the best chance of being able to claim asylum in this country. Yeah, absolutely. And mark, yeah, absolutely. And mark, just in terms of an update as to where we currently stand with the amount of people on the bibby stockholm barge, do we as of right now know if theres been that many more arrivals today at all . What the government want and this task force needs to try to do starting with the lawyers, of course, is to determine whether that help and support crosses the line into illegality. Now, what the daily mail uncovered recently seemed blatant illegality in terms of telling Asylum Seekers to make up a completely false back story of who they are and what situation they fled to ensure that they had the best possible chance of getting asylum. That that is, you know, quite a clear case for them to be able to pick up on and determine that laws have been broken. But going have been broken. But going further down the road of looking at more grey areas , it might be at more grey areas, it might be at more grey areas, it might be a bit more difficult. A bit more difficult. Yeah, absolutely. There is a line, a very clear distinction between somebody offering their services to help somebody who they think is in need and need some legal advice and support and somebody saying, look, i know if you say this, this, this and this, whether or not its true, they wont be able to prove it and therefore you can get off with it. And that is an avenue im going to be exploring shortly a legal expert. But shortly with a legal expert. But but that might but another area that might pique interest, pique the lawyers interest, mark, threat that has mark, is another threat that has been to those who been dished out to those who have been refused ing under this so called legal advice to go on the barge. But it is interesting in terms of, you know, the advice, again , you know, the advice, again, probably coming from lawyers and human Rights Groups. Now, in terms of, you know, a fear of water or disabilities trauma, would these Asylum Seekers necessarily themselves know about these potential avenues of appeal to get them off the boat . Is the reality of the situation in that if somebody comes to you and wants to stay in britain, you can quite easily make a case for trauma , fear of things, trauma, fear of things, potential Mental Health issues andifs potential Mental Health issues and its quite easy to sorry , and its quite easy to sorry, its not easy to disprove that. Is that where we are . Is that where we are . I dont think so , no. I dont think so, no. I dont think so, no. I dont think so, no. I think that if somebody came to a lawyer and said that they had been through a trauma experience, the lawyer, if the lawyer is behaving properly, should ask that person about the experience , about whether that experience, about whether that person had a well founded fear of persecution. Of persecution. If that person does, then the lawyer could make an asylum claim on their behalf. What a lawyer certainly cant do is offer to make something up, which is what emerge from the 3 or 4 cases revealed by the daily mail. And that led to three solicitors being suspended and their firms being closed down and a case worker being told that he couldnt be employed by any solicitor. But if i went to you as somebody who just crossed the English Channel said , the English Channel and said, ive from a charity ive got advice from a Charity Group here that i can avoid being put on this barge. Being put on this barge. And they said, well, how did you get to britain . Did you come across the channel . And they said, yes. Well, that must have been very scary for you, mustnt it, dinghy . And he said, it, on that dinghy . And he said, oh was very scared. Yeah oh yes, i was very scared. Yeah and then you can maybe say, well well say that you well just say that you traumatised mean traumatised of water. I mean would. Would that do. I dont think so. No. I think that be quite improper. I that would be quite improper. I can that somebody who can imagine that somebody who has a voyage of this has endured a voyage of this sort and you may perfectly reasonably say its that persons choice to try to enter the United Kingdom in that way. But imagine there are some but i can imagine there are some people would traumatised people who would be traumatised by wouldnt have been by it. They wouldnt have been expecting it to as bad as it expecting it to be as bad as it was. They well be was. They may well be traumatised. I think it may be quite difficult, even for somebody in that position to say that a stationary barge moored , that a stationary barge moored, moored to a jetty, a adjacent to dry land with the opportunity to take a bus into to the local town, i think itd be quite hard town, i think itd be quite hard to establish that that would retraumatize you. But you know, its possible that somebody might be able to produce medical evidence in those circumstance is examined by a doctor and in that circumstance, it would have to be considered. You are an upstanding member of profession. And of of the Legal Profession. And of that, be no doubt. That, there can be no doubt. However, everybody. However, you are not everybody. And being honest with and if youre being honest with me and on our viewers, how surprised were you to find that the daily mails sting operation unearthed people who were willing to take cash in hand to make stuff up and again, being honest, you think if you raided every single Solicitors Office who deals with immigration complaints right up and down the country, you might actually see quite lot more of that. Quite a lot more of that. Well, im legal commentator well, im a legal commentator , practising lawyer, but , not a practising lawyer, but nevertheless , yes, i nevertheless, yes, i was obviously disturbed to see what was discovered. I was impressed by the speed in which the regulator, the solicitors regulation authority, investigated the evidence produced by the daily mail and as i say, suspended. The three as i say, suspended. The three solicitors closed down their practises withdrew all their documents , withdrew all the documents, withdrew all the client money and brought in other to run the other solicitors to run the practise. I think that worked quite efficiently. How widespread is , we dont widespread this is, we dont know. There are some. Know. Clearly there are some. I cant believe its the majority. I dont think the government believes its the majority. The solicitors profession doesnt believe the majority. But believe its the majority. But yes, possible to yes, it is possible to act dishonestly in every profession and regulate was are there to stop that happening. Now, this afternoon, we heard from judge justice goss in this trial that now on day 15, he would be offering the jury, the majority direction. Now, what that means is until this point, the jury had been deliberating based on trying to come to unanimous verdicts. But now theyll be able to come to a majority verdict. Now, thats made slightly more complex by the fact that last week the jury of 12 became a jury of 11. Thats because one of the jurors, as the judge told us, had to drop out for what he called a good personal reason. Now, what that means is with this new majority direction, rather than all jurors having to agree on each count, instead it can be done on a 10 to 1 split. So the jury went back into their deliberating room. Once theyd heard that they had the majority direction. Court has now direction. Court has now finished for the day. So tomorrow , the jury thats now tomorrow, the jury thats now comprised of seven women and four men, they will continue their deliberations tomorrow to try and come to now a majority verdict on those 22 counts being faced by lucy letby. And if you saw the size of that, it is basically a prison cell. But this is the one that really got me. I also spoke to a woman whos been living there now for two years for the price of £1,500 a month. She has had little to no hot water, says it is not a safe area to bring up. Her daughter. I also, of course, asked her whether or not shed be happy to live in some of the accommodation that we are offering people whove just come to this country illegally and i even showed her of the even showed her some of the accommodation this is accommodation as well. This is what told for a short what she told me for a short penod what she told me for a short period of time maybe, its period of time maybe, but its not okay. Its you cant live like that i okay. Its exam ham okay. Its is its dirty. Once again , the home office has once again, the home office has said that this process of getting people on the barge wont be just weeks in duration , but actually months before they get to that 500 mark. And once they get to that 500 figure, well, even that in itself, thats only 1 of the 50,000 people currently staying in hotels. The people that rishi sunak says he wants removed from hotels and put into more basic accommodate asian. But i think the bibby stockholm is symbolic for the government. Its very for the government. Its very important because it is a very visible manifestation of the fact that they are at least making a start on the Prime Ministers pledge to put people in more basic accommodation. And in more basic accommodation. And as part of this week of action that the government is undertaking with a view, they say , to show that they are doing say, to show that they are doing more to try to stop the boats, they are looking at this issue around these lawyers and others who may be not just helping Asylum Seekers to get asylum in the uk, but actually perhaps breaking the law and helping them gain the system. There was a first meeting of this taskforce , this chaired by the taskforce, this chaired by the home secretary today, and they will make it their mission to look at these immigration lawyers to make sure that they are all playing by the letter of the law. Yeah, ive got a feeling this is going to be a big story of our time because it does appear that every single thing thats being tried at the moment is being tried at the moment is being frustrated. And if its being frustrated. And if its coming down to technicalities , coming down to technicalities, there are two ways to look at this, there . Is this, arent there . Which is that law is there for a very that the law is there for a very , very good reason. And it is an incredible protection. And if you anyone close to us you or i or anyone close to us ever really needed to get out of a tight spot, you would want very, skilled lawyers who very, very skilled lawyers who were look at your were able to look at your situation and make the best of it. And i think we can all agree that that is a good thing. There is also, of course, the flip side that, which that in side of that, which is that in situations exactly what situations exactly like what we are with migrant are in now with the migrant crisis, possible to crisis, if it is possible to claim people have a fear of claim that people have a fear of water when they have in fact travelled least travelled across at least two bodies of water and paid for the privilege in order get here privilege in order to get here willingly. First and foremost, do you think that our immigration Legal Profession needs a good investigation. Investigation. Well, you know, if a solicitor has lied on behalf of any client , then that is any client, then that is a matter for their regulatory body. It it is hard baked into all of us, both at the bar and as solicitors a that we dont produce evidence on behalf of our clients. Our clients. It is the clients case that we present now. Now you can we present now. Now you can advise your client on what the law is and you can advise your client on what aspects of the law they need to establish in order to win their case. But i think to suggest that all immigration lawyers are lying on behalf of their clients is a little bit of a stretch. And i dont think thats a very safe route to go down here. You have to remember that it is parliament that drafts the laws. It is judges that apply the law and it is the advocates. People like me and people like stephen who present the clients case. We cannot be the people to write the evidence. We merely present the evidence. We merely present the evidence. We merely present the evidence. We merely present the evidence. If you are writing the evidence. If you are writing evidence, you are committing malprave practise and you will be censured by your body for doing so. I mean, it was incredibly easy for the daily mail to unearth a handful of law firms, of course, that were doing just that. And i do think that if you went and knocked on a lot of solicitors firms in quite suspicious kind of areas, you might earth that there might well on earth that there is widespread is something widespread going on. Stephen, the very on. But but stephen, at the very least, i wonder whether or not we allowed a situation we are weve allowed a situation to this country to occur in this country where certain Charitable Organisations can very easily make a case and provide evidence on behalf of Illegal Migrants and that can be presented to law firms. And then presented to law firms. And then that finds its way in terms of stifling due process. Et cetera. And us controlling our borders where are you on this . Where are you on this . Well, the one thing pick you up on is you said in this country, because i would say that at the moment there is a global immigration problem and its International Law on immigration has got itself into a bit of a muddle and its causing problems everywhere. I mean, ive written one of the only journalists in the uk to have highlighted the fact that the eu stands accused of being responsible for the deaths of over 100,000 migrants and that it uses a Detention Centre in libya, which the un has condemned, and that some very well thinking human rights lawyers on the continent are outraged at what the eu is doing. I mean, there is a border on the eastern side of the which is effectively a wall and so we shouldnt for a start, we shouldnt for a start, we shouldnt assume this is just a uk problem or a uk solution. Uk problem or a uk solution. But on the broader point , i but on the broader point, i mean, im never going to do anything other than than echo. Rebecca that we want and the country needs and the system requires lawyers who are above reproach. One of my concerns is reproach. One of my concerns is that certain an overdramatise ization of criticism of lawyers has has led to people being unwilling or disinterested in criticising them. I, i frowned my a big frown appeared on my forehead very strongly when the daily mail reported that there were enemies of the people. And were enemies of the people. And then everybody seemed to get very hysterical about that. Its perfectly valid for the daily mail to criticise judges, whether people like it or not, or agree with the daily mail or not is their personal political opinion. People say rude things about may about lawyers. People say may shock you to hear this patrick, but they say or they tweet rude things about me and it does happen and we all have to just get over it. If were going to have a proper good system, we need to criticise because we need to criticise because we need investigate. If you need to investigate. If you dont hate, its dont investigate hate, its likely you know the bad likely that you know the bad apples corrupt the whole apples will corrupt the whole barrel. Barrel. Okay, rebecca, where are you on this idea, this threat . Ill just make a point. On this idea, this threat . Ill just make a point. Well, you just make a point. Well, you take it away. Yes you know, ive done briefs for the home office and given the long arm of the state and given the state has all of the Resources Available to it, to prepare cases and present them at quietly, i have to say, as a barrister going in for the home office that their cases are so appallingly badly put together and hugely shambolic. And hugely shambolic. Nick um , infrastructure nick um, infrastructure within the home office itself, because of the sheer volume of cases that theyre having to deal with, that, you know , deal with, that, you know, judges have really very little opportunity to assess the credibility of the, the claimant in that case. You know, the, the Asylum Seeker or the or the refugee , very little opportunity refugee, very little opportunity to consider the credibility of their stories. So how youre going to arrive at a mechanism whereby somebody is reporting on a solicitor to the for making up evidence is totally is beyond me thatis evidence is totally is beyond me that is fascinating. That is absolutely fascinating because thats kind of a situation where if a lawyer was unscrupulous, they know that the home office is being hammered at the moment, simply cannot cope. Its not really going to be able to look at the veracity of these claims. And those lawyers would know based on what youve said. And i think the evidence that we can see before that there a very before us that there is a very good that that lie will good chance that that lie will work and that stephen, i wonder if that is not part of the problem really, that if you did want to at the moment in this country, you really could put forward a load of tosh and probably get it through. Lawyers stand at the heart of the system because of that. Thats thats why its really important that were whiter than white. If you get, you know, if we fall corruption, then you we fall to corruption, then you have got a massive problem. And have got a massive problem. And simply proving it, as youve said , is quite clearly tricky. Said, is quite clearly tricky. Thats why things like the daily mail play a vital role. You know, journal ists play a vital role in our society. Know, journal ists play a vital role in our society. Think you play role in our society. Think you play a constitutional role in our society in keeping everybody on straight and narrow. And on the straight and narrow. And it perfectly right that it is perfectly right that lawyers must be investigated, even theres mere suspicion even if theres mere suspicion that that is right. What has been going wrong is the slightly mildly hysterical reaction to any criticism of lawyers, which has clearly disincentivized any further investigation. And thats thats not on. And people, you know, i will not stand here and swear blind that 100 of all of the functioning lawyers today are wholly on it that that to do so would be to mislead the public. I wont accuse them of anything either. Ill simply stay neutral and say that if you want a system that works, you must investigate and prosecute. Yeah and i suppose when you mentioned the word hysterical there, all of power , hysterical there, all of power, you know, Suella Braverman has all of the power to deal with this case. And it is not satisfactory that she blame us. The failings in the immigration system. On in the immigration system. On admittedly 1 or 2 dodgy lawyers which like stephen i agree they could well exist and you know thats fine. There are mechanisms to deal with it, but its not right for the government to lay the blame at the door of lawyers. The problem is the law, not the lawyers. This is it. I mean, we are i think both both of you have been really great, this actually. And i think the truth is somewhere throughout this conversation, which theres hysteria over which is theres hysteria over the criticism of lawyers. There the criticism of lawyers. There is also a threat of suddenly theres a prison for life, which is in itself hysterical. If you is in itself hysterical. If you look at it, there will be some rogue ones out there, but you cannot blame the fact that we are where we are singularly on a few rogue lawyers. Great chat, really enjoyed that. And so in recent weeks we have seen keir starmer really trying to distance himself from those groups , a feat which is made groups, a feat which is made harder by the fact that one of labours donors, dale vince, has also donated £1. 5 million to Just Stop Oil. So keir starmer was already on the back foot with this. And this has put him even further behind and will be really, really interesting to see if it reflects at all in the polls when we see the next set next week. The other problem for keir starmer, of course, is that it really highlights some of those internal divisions within labour environmental labour on environmental policies. As i say, recently we have seen keir starmer sort of try and row back on some of his more extreme seem green policies. So for example , a policies. So for example, a couple of days ago he actually said that he would not go back on rishi sunaks promise to grant 100 new likes leases to oil and gas providers in the north sea. And he called the tactics of Just Stop Oil and their aims even he called them contemptible. Well, how can he reconcile that with the fact that his own parliamentary candidate for mid bedfordshire , Nadine Dorries old bedfordshire, Nadine Dorries old seat is, if not a member of greenpeace, then at least very, very cosy with them. So its a real, really tricky situation. All around for keir starmer and i think perhaps highlights some deeper problems that the labour leader is going to have over the next few months in reconciling the real eco fanatics , if you the real eco fanatics, if you like, in the Labour Parliament party. And some of the more for swing voters in those seats that are going to be so important to him if hes to win the general election, who on the whole are more worried about the money in their pocket than abstract concerns about the environment . I spoke to a man called them. I spoke to a man called john and he told me that his accommodation was not fit for human habitation. He gave me human habitation. He gave me a quick tour. It didnt take long, frankly, because he is living in what, frankly . Well, prisoners wouldnt live in. But lets just take a look at this. Take a look at this. Some of the issues would be leaks every one of leaks from every single one of these joins here on the ceiling. And theres about 3 or of them and theres about 3 or 4 of them far alarm doesnt work. Thats that that was that conked out about a year ago now its a fire hazard. Fire hazard. Yeah. No no hot water in the shower and thats been the case more or less from when i moved in here back in 2020, december 2020. And as i said, this is literally it just this here, ive got the bed near here. Theres also a big problems with sound pollution. Theres no soundproofing. So when cars pull up there or lorries because were at the back of a Delivery Area for co op and places like that, you can hear everything. I had to get myself. What . It looked get one myself. What . It looked like cockroaches as well. Like little cockroaches as well. And i was formerly homeless for eight years, sleeping rough on the streets of ealing. And i was in streets of ealing. And i was in a hotel before that. Now they had to house me because of the only reason i even got housed at all under any , you know, even in all under any, you know, even in this kind of rather rather kind of rather kind of under edifying conditions is because of the coronavirus. You know, after coronavirus. You know, after that happened, they had to clear everyone off. So thats interesting. So. So you were homeless for a period of time . Eight years . Yeah. 2020, almost exactly eight years. March 20th, 2012 to march 2020. And they only housed you. They only found you this accommodation, which is, as weve seen , pretty, pretty basic weve seen, pretty, pretty basic to say the least , because of the to say the least, because of the coronavirus. Coronavirus. Otherwise, in theory, i could still be homeless, still sleeping rough parks , in sleeping rough in parks, in eaung sleeping rough in parks, in ealing and in doorways and so on. Can i ask you because the local mp and the local council have been very vocal recently about some of the accommodation that we are giving to people whove just arrived in this country illegally. Yeah. How country illegally. Yeah. How does that make you feel . Does that make you feel . Well, i mean, everyone should be housed, whether theyre, you know, whether theyre no matter what colour skin theyve got, no matter how they are, they should be housed.
