The criminal indictment against donald trump just filed by special counsel jack smith as the former president is once again accused of trying to overturn his 2020 election loss. The narrow scope of the charges after they Landmark Supreme Court ruling on president ial immunity appeared plus our exclusive interview with the justice who wrote a stinging dissent in that case. Tonight, our new report and the new context. The Cbs Evening News starts now. Special counsel jack smith is not giving up, filing a new federal indictment in the Election Interference Case against donald trump be a good evening, im norah odonnell, and thank you for being with us. The former president is facing the same for charges for his efforts to overturn the 2020 election. But the special counsel tailored the allegations to respect and implement the Supreme Courts new immunity standard. Now a big part of that came down to arguing what is an official act of the president versus a private one. And the timing is likely not coincidental. We are actually 70 days out from the election. Once we hit 60 days, the Justice Department has a role that new charges will not be filed against a nominee or someone tied to a political campaign. Cbss robert costa has the revised indictment, and he brings us the breaking news. Reporter the new indictment over Donald Trumps efforts to overturn the 2020 president ial election suddenly brings his conduct around the Capitol Attack back to the four of this years intensifying race for the white house. The slims down indictment from 45 pages to 36 pages still alleges trump engaged in conspiracy to hold onto Power Chromatic comes in the wake of a Supreme Court ruling that president s have brought immunity for official acts. It removed all the allegations concerning trumps attempts to pressure the Justice Department into supporting his false claims that the election was rigged. One of the unnamed coconspirator who cbs news identified as jeffrey clark, a trump loyalist within the doj, has been taken out of the new indictment. Trump has long claimed he did nothing wrong. This is a persecution of a political opponent. This was never supposed to happen in america. Reporter but still intact in the indictment, the charge he engaged in a conspiracy against the right to vote and have ones vote counted. Trump led sweeping efforts in the court and then when that failed began to pressure officials in congress added states to help him, including georgias republican Secretary Of State Brad Raffensperger after trump lost the state. I just want to find 11,780 votes. Reporter raffensperger spoke to 60 minutes and 2021. He was asking us to recalibrate or recalculate, i believe, some of the different answer. Reporter trumps lawyers are excited to fight this. President Trump Lawyers are going to say there is no indictment you could bring that does not involved official actions because former President Trump was in office at the time. Norah this is such a big development. Robert costa joins us now pizza what is the trump team saying in response to this new indictment . Reporter i just got off the phone with a source close to trump legal team. In the coming days they are going to ask for more time to brief these case because of these new developments which they expected. That means this could push a trial date past the election, or if the judge agrees to have the trial soon, trump could appeal all the weight of the Supreme Court. Norah the legal drama continues. Robert costa, thank you very much. In a broadcast exclusive, we spoke to Supreme Court Justice Ketanji Brown Jackson about her blistering dissent in that landmark immunity case. She granted cbs news her first tv interview since drying the nations highest court ahead of the publication of her memoir, lovely one. Here is what she set about what worries her about the decision in trump versus United States. In your dissent, you wrote that the court declared for the first time in history that the most powerful official in the United States can, under circumstances yet to be fully determined, become a law unto himself. Sounds like a warning. Well, i mean, that was my view of what the court determined. Norah you were concerned about broad immunity. I was concerned about a system that appeared to provide immunity for one individual under one set of circumstances. When we have a criminal Justice System that ordinarily treated everyone the same. Norah are you prepared that this election could end up who are for the Supreme Court . As prepared as anyone can be. [laughs] let me ask you, are you prepared for all of the news cycles that you are getting as a result of this one . [laughs] norah no. No exactly. I mean come i think there are eagle issues that arise out of the process of the super import has to be prepared to respond if that should be necessary. It was horrible. Reporter the raid comes after state Attorney General ken paxton recently announced an investigation into allegations of Election Fraud and vote harvesting, which began in 2022. The Attorney Generals Office said it had found enough evidence to obtain Search Warrants, which they executed last tuesday across three different counties. Lulacs president says this is voter suppression. It is evidence there are patterns of lawsuits, raids, searches, and seizures, that he is trained to keep latinos from voting. Reporter now the organizations asking the Justice Department to investigate paxton. In a letter first obtained by cbs news, they called his actions a serious violation of the civil rights of latino citizens. Cecelia casiano is running for a Hotly Contested State House seat and says officers executed a Search Warrant at her home. I believe this is plain old politics that the republicans are just trying to suppress the voice of the latino community, trying to suppress me. Thats not going to happen. Reporter we reached out to paxton for comment but did not hear back. Now propublica report found between january 2020 and september of 2022, paxtons Office Opened up at least 390 cases for potential election crimes, but of those cases, only five lead to conviction.
