Rahm emanuel about whats the u. S. Trying to accomplish. We begin this morning with the Devastating Hawaiin Wildfire S that ravaged maui. Police have identified three more victims. Nbcs tom llamas spoke with the family a 79yearold who was identified yesterday. Reporter remembering the man who for decades was the rhythm of lahaina. Music was the love of his life. Buddy jantoc spent life as a musician, touring country before settling down in his forever home of lahaina. Theyre sharing memories like this of uncle buddy playing weekend gigs at lahainas cannery mall. He was always smiling, always laughing. This as nbc news has reviewed a lawsuit accusing Hawaiian Electric of years of inaction and negligence, arguing it should have been planning to shut down Power Systems before the damaging winds hit. The Hawaiian Electric company declined to comment on the pending lawsuit. Nbcs Steve Patterson joins us this morning from maui. What more do we know about that suit and the investigation into the fires . Reporter jose, well start with the suit. It alleges gross incompetence and negligence, essentially. We heard, of course, since, you know, since the suits started, that there should have been a shutoff, that in essence when you have a wind event, you have 45mileanhour sustained winds predicted in the forecast on top of 60mileanhour gusts on top of dry brush that covers this island, there is the likelihood that a fire could start. And it could be a catastrophic fire and thats exactly what it was. What were also starting to understand sort of the depth of these lawsuits, alleging that there were Management Decisions that were made or maybe more importantly not made over years, talking about the sustainability of the grid and how it should have been hardened and strengthened, talking about Management Decisions that were made to prioritize what likelihood there would be a fire in the event of a major wind event. And so all of that is looked at, it is all part of that lawsuit. Meanwhile, there is more on the investigation about the conduct during the actual fire, during and before, i should say. We know that the State Attorney General will be conducting that investigation, that should be in effect widespread, there should be the availability of interviews and evidence that will be taken in. But also the legislature is pushing for the Attorney General to have a Third Party Investigator take on that. In case there are sort of any dilemmas or discrepancies that need to be addressed as well. So, all of this sort of going into what we have been hearing from residents and what we have been hearing from people on the ground who want more accountability, not only from public officials, but for the Emergency Managers who were in charge and were in charge at the time of this fire broke out. Jose . And, steve, as we speak to you, it is 5 03 in the morning your time. Some kids are going to be heading Back To School in maui maui . Reporter yeah, im glad you asked me. There is some good news. You can see behind me, the roads have started to open as of yesterday. The main thorough fare in the lahaina back open for everybody. And about an hour that will be completely open once again, sending traffic flowing back into town. But kids are going Back To Schools as well. It is a difficult process. Especially for people that lived there to try to get their kids to essentially what will be a separate school district. Were hearing three schools within lahaina almost actually completely survived. Theyre completely in tact. They have to do some Water Testing and air quality testing, but that is certainly good news for kids that could be going to those districts or to those schools as theyre able to determine that theyre safe. All sort of giving you signs of life that things are sort of starting to return as this horrific Search And Rescue and recovery effort is happening there in town as well. Jose . Steve patterson, thank you so very much. Joining us now from hawaii, Aubrey Velosas who survived the wildfires, a mother of three who lost everything in the wildfires except one photo. Aubrey, i cant even begin to tell you how much we all feel for you and for the so many people, families that have been so affected by this. But tell us a little bit about, well, what you went through, just a week ago. Well, i went through just like everybody else, we were on the loop of not having to evacuate because the fire was contained, apparently. That was what we were told. And our guards were down. We didnt have plan our whole evacuation. We were doing our normal day playing, cleaning, trying to entertain the kids because there was no school that day. And when the fire alarm went on in our house, the whole community started panicking outside because black smoke was just overtaking the whole community. And we didnt even realize that we have to evacuate. There was no warning. There was no Police Officer going to our neighborhood asking us to take our belongings or evacuate. So we had to we had to tell ourself that we have to go. And most people in my community, in my neighborhood, was just watering their plants, and trying to water their garden when we were evacuating. But there were all black smoke. So when i took my children out of the house, i didnt even i didnt even take any valuables with me. I just took my baby. Shes 10 months old. I was breastfeeding at that moment, and my twin daughters who are 6 years old, my partner took them and my mom got the van ready. We were all in the house. And we got in the van. And we were trying to move to our next familys house, which is five minutes away, which took us about two hours to get there. Five minutes away, took you two hours. It was just that chaotic and you ended up, unfortunately, the house that you were in is gone . My house is gone. The second house that we went to, which is t. C. , my partners house, and his grandparents house all connected are also gone. It took about four hours, again, for us to evacuate. And that second evacuation we had warning from the Police Officer to leave the property. So we went again to another yet evacuation and my house, my partners grandparents house and his parents are all gone. And we didnt take any belongings with us. My t. C. s parents happened to be in alaska at that time. So they were not able to take any valuables outside of their house. So nothing was saved except for our own lives, my children and my mom and all of the loved ones i know were all saved, which is thank god. And when i found that picture in go ahead. No, no. Im sorry. I saw everything gone except for that one picture and were looking at it right now. It is a little bit of that picture, the corner there is burnt, but it is clear. What does this picture mean to you and how did you find out it was there . A friend of mine was a fireman contacted me two days, maybe contacted me earlier, but i have no signal. All of Lahaina Electricity was down. And when he was trying to reach out to see if that was me, i said, oh, my gosh, that is me. And i asked him he found the picture. He said, i didnt, it was on social media, circulating. And they found the picture in lanai island, 40 miles from maui island. And i cannot believe it because i still have the hope the next following day that maybe the house is just burned outside, and that because we cannot go back to the residence. We were not allowed to go back. When we evacuated the first house, i was thinking i could still go back and just drop off the kids to the second house and come back for valuables, but the Police Officers were all saying there is no way we can go back. The next following day, we thought that we could go back to the second house at least to take some valuables, and we couldnt go back too. So i have that hope that something in the house is still in tact. But then when i found the picture, that was when all i realized everything is gone. Because that picture was on my daughters room, really thick album, and if its all the way in lanai island, a separate island, found, that means my house exploded, because we have a car parked in the garage, full tank, and i realize it was all gone. But it gave me hope though too because my great grandmother who raised me from most of my childhood has this way of telling me that everything is going to be okay. And i think that was her way, the one in the glasses, that was her way of telling me that i will get far too, even if there is scar on that fire that happened on 8 08, which is our phone number, 808, even though there is scars around, ill be fine, just like the picture, ill get far and everything will be okay. And i hope in my community as well that they find their hope just like i did. That everything will be okay. Yeah. Aubrey, i cant thank you enough for being with us. On wednesday, a woman was arrested in texas after she left a threatening racist voice mail to judge tanya chutkan, who is presiding over the federal election case from Special Counsel jack smith. An affidavit alleges the woman made a direct threat to kill judge chutkan. She now faces a charge of transmitting a threat to injure a person via interstate commerce. Meanwhile, Donald Trumps 2024 legal calendar is filling up. Now that Fulton County d. A. Fani willis Proposed A March 4th start date for the trial against the former president. That date falls on the eve of super tuesday, when multiple states have their primaries. It also falls right in between the proposed start date for the 2020 federal election trial and the classified documents case. Joining us now, nbc news correspondent Garrett Haake from atlanta for us, nbc news justice and intelligence correspondent ken dilanian and charles coleman, former brooklyn, new york, prosecutor and msnbc legal analyst. Ken, threats against judges have escalated into real harm. The killing of a son of u. S. District judge salas, another man arrested with a knife and a gun last year near the house of Justice Brett kavanaugh what do we know about this threat against judge chutkan . According to court papers, jose, abigail jo shry, 33, lives in alvin, texas, south of houston, called the chambers of judge chutkan after hours one evening and made this racist threat. Called her a stupid slave and the n word and then said we are coming to kill you. Essentially. And if donald trump is not elected, you will be targeted. The department of Homeland Security took this very seriously. Went to pay her a visit. She acknowledged making a threat. She said she didnt intend to act on those threats, but nonetheless, shes now charged and it emerged in the Court Proceedings against her that she had been previously arrested four times for making similar kinds of threats. I think what is notable here, jose, is that donald trump hasnt said a word about this case in condemnation or otherwise as he did not when the fbi shot and killed another one of his supporters who was armed in utah and threatening to assassinate joe biden. So were in a climate here where a group of people on the fringes are taking what they see on media and on social media literally and to heart and becoming very angry and some of the people that are ginning them up are not doing anything to lower the temperature, jose. So, ken, a fringe website that features violent rhetoric posted the purported personal information on monday in georgia. What do we know about this . This is another example of the climate were in right now. In georgia, unusual, the names of grand jurors are made public. Normally theyre secret. This group of Trump Supporters took these names, did some internet research, and doxxed them, published their addresses and identifying information on fringe websites. Were not going to disclose the websites because we dont want to advance and encourage this information. But it is no doubt a really Troubling Development for them and their families and for Law Enforcement and it sort of speaks to the kind of climate that were in and the use of the internet to really try to harm people. So, wait, just to get an update on this, in the state of georgia, the grand jurors in whatever case, their public their information is made public or just their names . Just their names, jose. So that obviously made it very easy for people to do some research and gather their addresses and other personally identifying information and publish them. The idea that their names are made public seems like a relic of a distant age and maybe georgia officials are taking another look at that policy. This is that has happened as a result and it is probably very concerning for them and their families. Indeed. Garrett, meanwhile, the d. A. Proposed a march 4th start date. What happens next . We have not seen any of the 19 people indicted in this case even show up to surrender. Thats the first real deadline at noon on friday. All of these folks are expected to surrender and in georgia, that process is separated from the Arraignment Process so the due date for that would be two weeks later, basically the week of labor day, september 5th. They would be expected to be arraigned. After that, well see if this trial date gets under way. As you pointed out in the top segment here, it is a very busy calendar for the former president next year between the political and the legal. March 4th, the proposed trial date here. March 5th, super tuesday. And the one thing that has been consistent across all of Donald Trumps various legal teams in various cases has been the effort to delay. And to push back trial dates as far as they possibly can. Trump has posted about that on social media, repeatedly. Even today, suggesting he doesnt want to see this trial or any others start until after the president ial election. I wouldnt be surprised if we see filings to that fact from his attorneys sooner rather than later. They dont want to do this anytime in the primary or the general election if they can possibly avoid it. So, charles, not withstanding what the former president may or may not want, how likely is it this case goes to trial on the 4th of march . Well, jose, i do think that the 4th Of March Next year for a case like this is a potentially plausible date. I do think it is a viable schedule. I dont necessarily it will hold. What i expect Donald Trumps defense team to do in this series of cases is to use the furthest date out, which currently we have in the maralago case under judge collins in south florida, that being may 20th, 2024, as the benchmark date and try to get the other cases he has and continues to accrue to follow that case. Essentially that they call in the legal space tracking. So those cases will track that initial case, number one, because it is the first one that is filed. Thats their argument. But then number two, theyre also going to be secretly pushing for that because right now thats the date that is furthest out. It is important to understand, however, that none of the judges in this case in these other cases are bound by that date. They dont have to let their case track. This other case. If they feel like, look, these other criminal cases are ready to go, especially because fani willis is on the state level and jack smith is on a federal level, they can move those cases along and move them forward. So, that march date could potentially move forward, even as there may be some delays. I do think it is a viable schedule. But i do expect that Donald Trumps team will continue to try and delay.
