Town Counsel: Selectmen Cannot Serve As Board, Committee Designees

Bourne Town Counsel Robert S. Troy has advised town officials that recently elected selectwoman Mary Jane Mastrangelo cannot serve on the Bourne Wastewater Facility Design and Building Committee as the designee of the Bourne Capital Outlay Committee. She can, however, serve as the designee of the Bourne Board of Sewer Commissioners, despite a provision in the Bourne Town Charter prohibiting selectmen/sewer commissioners from serving on other town boards and committees.
Mr. Troy offered his opinion on the matter in an email response to several questions posed by the Bourne Board of Selectmen. Board members asked if the capital committee has the authority to designate someone who has resigned from the committee as the group’s representative to the wastewater building committee.
