House of Representatives last month on Wednesday the Democrat controlled chamber passed the impeachment charges over to the Senate for the president's trial the Republican majority there is expected to acquit him but on Saturday we got the 1st formal indication of how Mr Trump's lawyers intend to fight the charges and more from our correspondent in Washington Ben right well it's clear that Donald Trump's legal team want to attack these impeachment articles on 2 fronts really they're disputing the basic facts of the case being presented against them they also think that the procedure was illegitimate unconstitutional is his word on a variety of fronts and so it's a pretty robust attack that Donald Trump's legal team has issued and it's a sign obviously of the for us ot of the legal battle that we're going to see on the floor of the Senate we were expecting both sides to issue their initial legal arguments in something that the Senate requires them to do so these are the early skirmishes before the trial gets going proper On Tuesday you know interesting are they says it as an attack on the right of the American people to choose their president are they appealing if you like over the heads of the Senate to the the voters they certainly are and that has been president Trump's tactic throughout this that you've seen in the tweets that he sent out comments that he's made publicly he wants to frame the whole impeachment saga as the obsession of Washington insiders the Democrats who only care about this sort of procedure and constitutional delicacies as President Trump would see it and ignoring the interests and concerns of ordinary voters out in America and so I think he will be framing this whole thing as a sort of Washington against the country which of course fits into a narrative that he set up and running this is the day that he decided to stand for the presidency Meanwhile the Democrats say the Senate should remove President Trump to avoid serious and long term damage to the country's values and security I guess we've heard the Democrat arguments while the whole impeachment process has been going on in the house. We have and they feel they've got a very robust case they feel that it's quite clear that President Trump abused his office his power to put pressure on the Ukrainian government to dig dirt and find out stuff that could damage Joe Biden one of President Trump's likely rivals come the end of this year and that he threatened they would say to withhold military aid to Ukraine as a way of exerting leverage on the Ukrainian government so that is what the Democrats are arguing in their summary of the legal case that they're putting forward their familiarity arguments they feel their robust president counterattack is that the White House doesn't feel as anything that the Democrats have put forward in these articles of impeachment that prove illegality Now one problem I think both sides have is that the Constitution is actually very vague when it comes to defining what constitutes an impeachable offense it talks about there being serious crimes and misdemeanors if a president is convicted of those then they can be removed from office both the White House and the House Democrats who are prosecuting this case have very I had different ideas about what constitutes a high crime and a misdemeanor and right in Washington a minor of our main news Prince Harry and his wife Meghan Duchess of Sussex have agreed not to use their h.r.h.
